Part 1 Water and Other Legislation Amendment Regulation (No. 1) 2012 Part 1 Preliminary [s 1] Preliminary 1 Short title This regulation may be cited as the Water and Other Legislation Amendment Regulation (No. 1) 2012 . (2) Section 50(e)(ii) ‘mining operations’— omit, insert— ‘a resource activity or mining operations’. (3) Section 50(da) and (e)— renumber as section 50(e) and (f). 10 Amendment of s 51 (Placing fill in a watercourse, lake or spring—Act, s 814) (1) Section 51— insert— ‘(da) an environmental authority (chapter 5A activities) under the Environmental Protection Act 1994 ; or’. Water and Other Legislation Amendment Regulation (No. 1) 2012 Part 3 Amendment of Water Regulation 2002 [s 11] 11 Amendment of s 62 (Code for self-assessable development—Act, s 1014) Section 62(c), ‘1(b)(ii)’— omit, insert— ‘1(e)’. 12 Amendment of s 76 (Metering service charge—Act, s 1014) Section 76(3)(b)(ii), second mention— renumber as section 76(3)(b)(iii) . 13 Insertion of new pt 9, div 10 Part 9— insert — ‘Division 10 Transitional provision for Water and Other Legislation Amendment Regulation (No. 1) 2012 ‘131 Carrying out particular activities under environmental authority ‘(1) This section applies to an environmental authority that permits the holder of the authority to carry out, under the document called ‘Guideline—Activities in a watercourse, lake or spring associated with mining operations’, any of the following activities— (a) destroying vegetation in a watercourse, lake or spring; (b) excavating in a watercourse, lake or spring; (c) placing fill in a watercourse, lake or spring. ‘(2) From the commencement of this section, a reference in the environmental authority to the document mentioned in subsection (1) is taken to be a reference to Page 8 2012 SL No. 120
