2 Water Amendment Regulation (No. 6) 2006 No. 202, 2006 Preamble— Reasons for the making of this regulation, and the context of its operation— 1 The current drought in South-East Queensland is the worst on record. To respond to the drought, powers under the WaterAct 2000 are being used to implement a strategy to secure the essential water supply needs of the region. 2 This strategy includes the following— • ensuring that losses from existing water supply systems are minimised or removed, as efficiency improvements to local government owned infrastructure would reduce losses by up to 22000ML per year and that water would otherwise be available for supply to domestic users; • facilitating the provision of treated recycled water to industry and rural users to replace their current reliance on ordinary water from dams, because currently, approximately 240000ML of waste water in South-East Queensland is discharged into the environment, some of which water could be used to supply the water needs of industry, farmers and sporting and recreational facilities, etc.; • encouraging existing home owners to reduce their water consumption and their reliance on local government supplied water by the provision of grants and free services to enable home owners to install tanks and pool covers and water efficiency devices; 1 • introducing new rules to facilitate the installation of new water tanks and other storages and water efficiency devices in new homes or housing developments; 1 To ensure that this element of the strategy succeeds, it may be necessary to take action so that local government administrative fees and charges do not have the effect of undermining the value of rebates. Additional measures may also be needed to modify procedural requirements in local government administration, for example, development controls, that are not consistent with the operation of the strategy.
3 Water Amendment Regulation (No. 6) 2006 No. 202, 2006 • establishing a water grid that enables water to be moved between storage facilities throughout South-East Queensland; 2 • creating additional water through the construction of desalination facilities to introduce additional supplies of water into the water grid; • increasing the capacity of existing storage systems by— (a) accessing underground water supplies; and (b) water harvesting; and (c) raising dam and weir walls if practicable; • building new dams in the catchments of the Logan River (Wyaralong Dam) and Mary River (Traveston Crossing Dam) to maximise prospects of capturing water in storage facilities dispersed across South-East Queensland. 3 In South-East Queensland, as in other parts of the State, the supply of water for irrigators and some smaller towns is the responsibility of SunWater, a State government owned corporation. 4 Responsibility for the supply of treated water for domestic, commercial and industrial users rests with local governments. These supplies are delivered through the local government owned water supply businesses (such as Brisbane Water), and other entities that are either wholly owned by local governments (such as Aquagen) or majority owned by local governments (such as SEQ Water). These businesses own dams, treatment plants and pipelines. 2 It is recognised that some local governments have planned more effectively than others to meet the needs of their communities. This, combined with variable rainfall patterns throughout catchments in the region, means that some parts of the region have substantial water resources while others are facing severe shortages. The water grid will create the ability to move surplus water from water rich parts of South-East Queensland to areas of South-East Queensland where supplies are stretched. Operating principles to be established for the grid will ensure, however, that the overall water resource is managed in a way that does not lead to the imposition of restrictions on residents of areas whose local governments have responsibly planned supplies to meet local demand. Only water that is excess to the requirements of those local government areas will be eligible for transfer to elsewhere in South-East Queensland.
4 Water Amendment Regulation (No. 6) 2006 No. 202, 2006 5 To implement the water strategy for South-East Queensland and to meet the water requirements of the region, there needs to be a coordinated set of actions undertaken by all local governments and their water supply businesses, and the State. This regulation requires local governments and other service providers to undertake a number of measures, to ensure that all elements of the strategy are implemented in a timely and coordinated way. Timelines for completion of the actions, as well as State funding contributions for some actions, are outlined in this regulation. 6 To ensure that South-East Queensland has a robust long term plan to provide secure and reliable water to its citizens, this regulation also outlines other major infrastructure developments to be undertaken, some of which will be undertaken by local governments with State funding contributions as equity (such as the desalination plant at the Gold Coast), and others that will be undertaken wholly by the State either directly or through State owned or controlled entities (such as the dams at Traveston Crossing and Wyaralong). 7 In addition to the actions outlined in this regulation, State government departments and other entities that are major users of water (such as the Department of Public Works, the Department of Health, the Department of Education and the Arts and the Major Sports Facilities Authority) will be required to implement programs to reduce the amount of water consumed under their control, including programs for retrofitting water efficiency devices, reducing leaks and assessing recycling options. The Department of Natural Resources, Mines and Water will be required to examine how to reduce use of ordinary water by irrigators in cases where it could be made available for urban supplies and the needs of irrigators could alternatively be met from recycled water. 8 The drought is as severe in the City of Toowoomba and surrounding local governments that take supplies from Toowoomba. However, the co-ordination difficulties that exist in other parts of South-East Queensland do not exist in Toowoomba. In addition, a task force has been established to develop contingency options for Toowoomba. For these reasons, specific measures have not been included in this regulation at this stage.
5 Water Amendment Regulation (No. 6) 2006 No. 202, 2006 9 Service providers with obligations outlined in this regulation and government entities will be required to report regularly on progress to both the Queensland Water Commission and the Minister. These reports will be available on the department’s website to ensure the service providers and the State entities are publicly accountable for progress against the requirements applying to them. 10 In addition to the measures outlined in this regulation, powers will be exercised under the LocalGovernmentAct1993 requiring local government owned service providers to furnish information on the financial performance of water businesses since 30 June 2000 (including details of revenues, costs and profits, franchise fees, transfer payments to other local government businesses, and prices paid to bulk water storage providers and water retailers). Information will also be sought on income projections and asset management programs to 30 June 2008. A similar request will be made of State owned water businesses, and the information on all service providers will be published.
s1 6 s3 Water Amendment Regulation (No. 6) 2006 No. 202, 2006 1 Short title This regulation may be cited as the Water Amendment Regulation (No. 6) 2006 . 2 Regulation amended This regulation amends the Water Regulation 2002. 3 Insertion of new pt 8 After section 81— insert — ‘Part 8 Water supply emergency (SEQ Region) ‘82 Purpose of pt 8 ‘(1) This part is a water supply emergency regulation under the Act. ‘(2) The purpose of this part is to outline a range of measures to be carried out, and outcomes to be achieved, by service providers, and works to be carried out by the coordinator-general, to ensure the security of essential water supplies for the SEQ region. ‘(3) The measures, outcomes and works include— (a) the following measures— (i) the construction of the Western Corridor Recycled Water Scheme (Stages 1A, 1B and 2); (ii) the construction of the Southern Regional Water Pipeline; (iii) the construction of the Eastern Pipeline Inter-connector; (iv) the construction of the Northern Pipeline Inter-connector; (v) the construction of the South East Queensland (Gold Coast) Desalination Facility;
s3 7 s3 Water Amendment Regulation (No. 6) 2006 No. 202, 2006 (vi) the construction of Traveston Crossing Dam Stage 1; (vii) the construction of Wyaralong Dam; (viii) the raising of Mt Crosby Weir; (ix) the raising of Hinze Dam Stage 3 and preparing for associated water harvesting works; (x) the development of underground water resources at Bribie Island and in the area around Brisbane; and (b) the following outcomes— (i) demand management strategies including ensuring service providers’ participation in pressure and leakage reduction programs and a domestic retrofit program; (ii) other water efficiency outcomes aimed at greater use of recycled water for industrial and commercial customers and reduced water use by power stations; (iii) maximising the sustainable take of water, including the sustainable take of groundwater from North Stradbroke Island; and (c) the following works— (i) the construction of Cedar Grove Weir; (ii) the construction of Bromelton Off-stream Storage. ‘83 Definitions for pt 8 ‘In this part— Bromelton Off-stream Storage means the offstream storage of that name proposed under the Water for South East Queensland document. Cedar Grove Weir means the weir of that name proposed under the Water for South East Queensland document. Eastern Pipeline Inter-connector means the Regional Water Inter-connector of that name mentioned in the Report on Drought Contingency Projects.
s3 8 s3 Water Amendment Regulation (No. 6) 2006 No. 202, 2006 Hinze Dam Stage 3 means the dam raising of that name proposed under the Water for South East Queensland document. LGIS means Local Government Infrastructure Services (ACN 115 959 021). MOU means the Memorandum of Understanding for the South East Queensland Regional Water Leakage and Pressure Management Project, dated 28 April 2006. Northern Pipeline Inter-connector means the Regional Water Inter-connector of that name mentioned in the Report on Drought Contingency Projects. participating local government means each of the following local governments that are signatories to the MOU— (a) Beaudesert Shire Council; (b) Boonah Shire Council; (c) Brisbane City Council; (d) Caboolture Shire Council; (e) Caloundra City Council; (f) Esk Shire Council; (g) Gatton Shire Council; (h) Gold Coast City Council; (i) Ipswich City Council; (j) Kilcoy Shire Council; (k) Laidley Shire Council; (l) Logan City Council; (m) Maroochy Shire Council; (n) Noosa Shire Council; (o) Pine Rivers Shire Council; (p) Redcliffe City Council; (q) Redland Shire Council.
s3 9 s3 Water Amendment Regulation (No. 6) 2006 No. 202, 2006 raising of Mt Crosby Weir means the weir raising of that name proposed under the Water for South East Queensland document. Regional Water Inter-Connectors means the drought contingency projects mentioned in the State Development Regulation under that collective name. Report on Drought Contingency Projects means the document of that name mentioned in the State Development Regulation, section 2. South East Queensland (Gold Coast) Desalination Facility means the drought contingency project referred to in the State Development Regulation as the Tugun Desalination Plant. Southern Regional Water Pipeline means the drought contingency project mentioned in the State Development Regulation under that name . State Development Regulation means the State Developmentand Public Works Organisation (Water Infrastructure ProjectBoard) Regulation 2006. Traveston Crossing Dam Stage 1 means the dam of that name proposed under the Water for South East Queensland document. Water and Sewerage Program means a capital works subsidy program administered by the Department of Local Government, Planning, Sport and Recreation. Water for South East Queensland document means the document called ‘Water for South East Queensland—A long term solution’, held by the department. Water Infrastructure Project Board means the project board the subject of the State Development Regulation. Western Corridor Recycled Water Scheme means the drought contingency project mentioned in the State Development Regulation under that name. Wyaralong Dam means the dam of that name proposed under the Water for South East Queensland document.
s 3 10 s 3 Water Amendment Regulation (No. 6) 2006 No. 202, 2006 ‘84 Water supply emergency to which pt 8 applies ‘(1) This part applies to a water supply emergency that is developing. ‘(2) The water supply emergency involves the essential water supply for the SEQ region for— (a) domestic purposes; and (b) essential services. ‘(3) The water supply emergency arises from extended severe drought conditions. ‘(4) Also, a potential shortfall in supply will exist if there are limited rainfall events within the next 3 years and the requirements of this part are not implemented. ‘85 Part of State to which pt 8 applies ‘This part applies to the SEQ region. ‘86 Service providers to which pt 8 applies ‘This part applies to the service providers mentioned in schedule 10A. ‘87 Measures to be carried out ‘(1) A service provider mentioned in schedule 10B— (a) is directed to carry out each measure listed for the service provider in the schedule, before the day mentioned in the schedule; and (b) must give the Minister and the commission a written report on the service provider’s progress in carrying out the measure within 5 business days after the end of— (i) each month; or (ii) any longer period the Minister directs. ‘(2) Without limiting subsection (1), any actions taken in carrying out a measure must be directed at attaining water saving or
s 3 11 s 3 Water Amendment Regulation (No. 6) 2006 No. 202, 2006 water availability, as the case may be, to the extent of any target mentioned in the schedule for the measure. ‘(3) In carrying out a measure, a service provider must comply with any directions or requirements given or made by the Minister in relation to the measure. Example of direction — a direction to advise the Minister of a detailed break-down of likely progress in carrying out a measure ‘(4) In addition to any other measure a service provider is directed to carry out under this part, each service provider must give each other service provider the advice and other assistance the other service provider reasonably requires in formulating any water supply emergency response the other service provider is directed to give under this part. ‘(5) For each measure in schedule 10B, item 3, 4, 6, 7, 8, 9 or 10, that a service provider is directed to carry out, the service provider must, in carrying out the measure, consult with the Water Infrastructure Project Board about matters under the State Development Regulation and keep the commission informed of its progress. ‘(6) A service provider is not required to complete the carrying out of a measure if the work required for the carrying out of the measure becomes work to be carried out by the coordinator-general. ‘88 Outcomes to be achieved ‘(1) A service provider mentioned in schedule 10C— (a) is directed to achieve each outcome listed for the service provider in the schedule, before the day mentioned in the schedule; and (b) must give the Minister and the commission a written report on the service provider’s progress in achieving the outcome within 5 business days after the end of— (i) each month; or (ii) any longer period the Minister directs.
s 3 12 s 3 Water Amendment Regulation (No. 6) 2006 No. 202, 2006 ‘(2) Without limiting subsection (1), any actions taken in achieving an outcome must be directed at attaining water saving or water availability, as the case may be, to the extent of any target mentioned in the schedule for the outcome. ‘(3) In achieving an outcome, a service provider must comply with any directions or requirements given or made by the Minister in relation to the outcome. ‘(4) For each outcome in schedule 10C, item 3 or 4, that a service provider is directed to achieve, the service provider must, in achieving the outcome, consult with the Water Infrastructure Project Board about matters under the State Development Regulation and keep the commission informed of its progress. ‘89 Directions for giving water supply emergency response ‘A service provider that is directed under this part to achieve an outcome is also directed to give the Minister for approval a water supply emergency response, stating the actions the service provider intends to take to achieve the outcome, and complying with the requirements mentioned in schedule 10D, before the day stated for the service provider in the schedule. ‘90 Works to be carried out by coordinator-general ‘(1) The works that are to be carried out by the coordinator-general are the following— (a) the Cedar Grove Weir; (b) the Bromelton Off-stream Storage. ‘(2) If the coordinator-general is carrying out a measure mentioned in schedule 10B, the measure is works that are to be carried out by the coordinator-general. ‘91 Costs ‘(1) State contributions to outcomes are stated in schedule 10C. ‘(2) In relation to a measure mentioned in schedule 10B that is for a drought contingency project mentioned in the State Development Regulation, State contributions, in the form of
s 4 13 s 4 Water Amendment Regulation (No. 6) 2006 No. 202, 2006 equity, to the measure will be negotiated through the Water Infrastructure Project Board. ‘(3) Subject to subsections (1) and (2), each service provider is to pay the cost of carrying out each measure it is directed to carry out and of achieving each outcome it is directed to achieve. Note — Within 6 months of the commencement of this regulation, it is intended to carry out a review of the operation of this section, including a consideration of the following— (a) calculation of the expected project costs for each measure and outcome; (b) financing arrangements for measures, including debt and equity contributions and rates of return; (c) advice from the commission under section 360E of the Act on how costs should be shared between service providers and their customers. ‘(4) The State will not recover from service providers State contributions mentioned in subsection (1). ‘(5) Each service provider may recover its costs and any rate of return in the way, and to the extent, that is consistent with its pricing policies and, subject to section 25Q of the Act, the jurisdiction of the Queensland Competition Authority.
