Water Amendment Regulation (No. 4) 2010 [s 1] 1 Short title This regulation may be cited as the Water Amendment Regulation (No. 4) 2010 . 2 Regulation amended This regulation amends the Water Regulation 2002. 3 Insertion of new ss 52AA and 52AB Part 6, before section 52A— insert— ‘52AA Definition relevant customer ‘For the Act, section 360ZCB(8), definition relevant customer — (a) each of the following purposes is prescribed, if any quantity of water is used for the purpose— (i) operating a public swimming pool; (ii) conducting a business consisting predominantly of growing and selling plants or plant produce, including, for example, a nursery, turf farm or market produce business; (iii) operating a cooling tower; (iv) irrigating an area of 500m 2 or more; and (b) any other purpose is prescribed, if the quantity of water used for the purpose is 10ML or more. ‘52AB Cancellation of approved water efficiency management plan ‘(1) This section prescribes, for section 360ZCKA(1)(b) of the Act, requirements a customer must satisfy for cancellation of an approved water efficiency management plan. Water Amendment Regulation (No. 4) 2010 [s 4] ‘(2) The customer must show, to the reasonable satisfaction of the relevant entity for the plan, that the quantity of water use at the relevant premises— (a) has been, for at least 1 year immediately before the application for cancellation is made, less than 10 megalitres a year; and (b) is not likely to exceed 10ML a year.’. 4 Amendment of sch 10A (Service providers) Schedule 10A, after entry for a new water entity— insert— ‘each distributor-retailer under the South-EastQueenslandWater (Distribution and Retail Restructuring) Act 2009 ’. 5 Amendment of sch 10B (Measures) (1) Schedule 10B, item 15, column headed ‘Description of measure’, from ‘‘Notice’ to ‘6 November 2007’— omit, insert— ‘‘Residential high water users program procedure’ published by the commission and dated 1 July 2010’. (2) Schedule 10B, item 16, column headed ‘Description of measure’, from ‘‘Notice’ to ‘6 November 2007’— omit, insert— ‘‘Non-residential high water users program procedure’ published by the commission and dated 1 July 2010’.
