Water Amendment Regulation (No. 3) 2010 [s 1] 1 Short title This regulation may be cited as the Water Amendment Regulation (No. 3) 2010 . 2 Commencement Sections 7, 13, 15, 16 and 17 commence on 1 July 2010. 3 Regulation amended This regulation amends the Water Regulation 2002. 4 Omission of s 6 (Nominated persons—Act, s 168) Section 6— omit . 5 Amendment of s 23 (Conditions of water bore driller’s licence—Act, s 302) (1) Section 23(1)(d)— omit . (2) Section 23(1)(ca)— renumber as section 23(1)(d). (3) Section 23(1)(e), ‘5 years’— omit , insert — ‘10 years’. Water Amendment Regulation (No. 3) 2010 [s 7] 7 Insertion of new pt 2A After section 24— insert — ‘Part 2A Annual levy payable to commission—Act, section 360F ‘24A Definitions for pt 2A ‘In this part— commission income statement means the commission’s income statement for the relevant financial year as contained in the document called ‘Service Delivery Statement’ prepared by the commission and published in the State budget for the relevant financial year. Editor’s note — A copy of the ‘Service Delivery Statement’ is available for inspection at < estimated user charges are the estimated user charges stated in the commission income statement for the relevant financial year. relevant financial year means the financial year for which the levy is payable. relevant water service provider means each of the following authorities, established under the SouthEastQueenslandWater (Restructuring) Act 2007 , section 6— (a) Queensland Bulk Water Supply Authority, trading as Seqwater; (b) Queensland Bulk Water Transport Authority, trading as LinkWater; (c) Queensland Manufactured Water Authority, trading as WaterSecure. ‘24B Amount and apportionment of annual levy ‘(1) The total annual levy amount must be based on a financial year. Water Amendment Regulation (No. 3) 2010 [s 7] ‘(2) The total annual levy amount payable under section 360F of the Act for a relevant financial year is an amount up to the amount of the estimated user charges for the financial year. ‘(3) The total annual levy amount decided under subsection (2) is to be apportioned among the water service providers as follows— (a) for each relevant water service provider—one-third of the total annual levy amount; (b) for each water service provider other than a relevant water service provider—nil. ‘24C Requirements for notice of annual levy ‘(1) If the amount of the levy apportioned to a water service provider under section 24B(3) is more than nil, the chief executive officer of the commission must give the water service provider a notice about the levy payable by the water service provider. ‘(2) The chief executive officer of the commission may give a notice to a water service provider on a quarterly basis or at an interval decided by the chief executive officer of the commission (the levy period ). ‘(3) The notice must state the following— (a) the relevant financial year; (b) the levy period to which the notice applies; (c) that the levy becomes payable on the day the notice is given; (d) the amount of the levy payable by the water service provider; (e) the day by which the levy must be paid (the due date ); (f) the way in which the levy must be paid; (g) that if the levy is not paid by the due date, the State may, under section 360F(3) of the Act, recover from the water service provider the amount of the levy as a debt. 2010 SL No. 138 Page 5
Water Amendment Regulation (No. 3) 2010 [s 8] ‘24D Payment of annual levy ‘(1) The levy becomes payable by a water service provider on the day the water service provider is given a notice under section 24C(1). ‘(2) The water service provider must pay the levy— (a) within 30 days after the chief executive officer of the commission gives the water service provider the notice; and (b) in the way stated in the notice.’. 8 ‘62A Replacement of s 62A (Accounting period—Act, sch 4, definition water year ) Section 62A— omit , insert — Accounting period—Act, sch 4, definition water year ‘The accounting period for a resource operations plan, interim resource operations licence or water licence for schedule 4, definition water year , paragraph (a) of the Act is— (a) if the accounting period for the plan or licence is stated in the relevant water resource plan, resource operations plan, water sharing rules or seasonal water assignment rules (the relevant plan or rules )—as stated in the relevant plan or rules; or (b) if the accounting period for the plan or licence is not stated in the relevant plan or rules—as otherwise prescribed under this regulation; or (c) if the accounting period for the plan or licence is not stated in the relevant plan or rules and not otherwise prescribed under this regulation—as stated in the licence; or (d) if the accounting period for the plan or licence is not stated in the relevant plan or rules, not otherwise prescribed under this regulation and not stated in the licence—from 1 July to 30 June in the following year.’.
