I, IAN GORDON CAMPBELL, Minister for Local Government, Territories and Roads, make the following Regulations under the Water Agencies (Powers) Act 1984 (WA) (CI).

1Name of Regulations

These Regulations are the Water Agencies (Infringements) Regulations 1994 (WA) (CI) Amendment Regulations 2004 (No. 1) .

2Commencement

These Regulations commence on the date of their notification in the Gazette.

3Amendment of Water Agencies (Infringements) Regulations 1994 (WA) (CI)

Schedule 1 amends the Water Agencies (Infringements) Regulations 1994 (WA) (CI).

5Authorised, designated and prescribed persons (Act s 103)

For section 103 of the Act:

authorised person means a person who is authorised, by a prescribed person, to give an infringement notice in respect of an alleged offence under by-law 2 (1) of the Water Agencies (Water Restrictions) By-laws 1998 (WA) (CI).

designated person means the person holding, or acting in, the office known as Operations Manager, Water Corporation, Christmas Island.

prescribed person means:

1. (a)

   the person performing the duties of Assistant Secretary, Territories Branch of the Department of Transport and Regional Services; or

2. (b)

   the Administrator, within the meaning given in the Administration Ordinance 1968.
