WATER AGENCIES (INFRINGEMENTS) AMENDMENT REGULATIONS 1998

Made by the Governor in Executive Council.

Citation

1.These regulations may be cited as the Water Agencies (Infringements) Amendment

Regulations 1998.

Principal regulations

2. In these regulations the Water Agencies (Infringements) Regulations 1994 *are referred

to as the principal regulations.

Regulation 3 repealed and a regulation substituted

3.Regulation 3 of the principal regulations is repealed and the following regulation is

substituted —

Prescribed offences

3.  The offences created by —

(a) by-law 6.2.7.3 of the Metropolitan Water Supply, Sewerage and Drainage

By-laws 1981; and

(b) by-law 76 (3) of the Country Areas Water Supply By-laws 1957,

Regulation 4 amended

4.    Regulation 4 of the principal regulations is amended by deleting "the offence referred

to in regulation 2." and substituting the following -

each of the offences referred to in regulation 3. ".

Regulation 5 amended

5.   Regulation 5 of the principal regulations is amended by deleting paragraphs (a) and (b)

and the "and" between them and substituting the following -

(a) General Manager, Customer Services Division;
(b) Regional Manager, Perth Region;
(c) Regional Manager, North West Region;
(d) Regional Manager, Mid West Region;
(e) Regional Manager, Goldfields and Agricultural Region;
(I) Regional Manager, South West Region; and

(g) Regional Manager, Great Southern Region.

Schedule amended

6.    (1) Form 1 in the Schedule to the principal regulations is amended -

(a)

by deleting all the words from "offence of using" to "those by-laws." and substitut- ing the following -

offence of -

(tick appropriate box)

o

using or consuming water in contravention of an order made and published under by-law 6.2.7 of the Metropolitan Water Supply, Sewerage and Drainage By-laws 1981, contrary to by-law 6.2.7.3 of those by-laws;

o

using water, or a hose, device or sprinkler, in contravention of a notice published under by-law 76 (2) of the CountryAreas WaterSupplyBy-laws

1957, contrary to by-law 76 (3) of those by-laws.
(b) under the words "You may dispose of this matter either - "by deleting paragraph
(a) and substituting the following -

(a)

by payment of the modified penalty of $40 within 21 days of the date of this notice by mail to -

(make cheques payable to Water Corporation);

and

(c) by deleting everything after "against you.".

(2) Form 2 in the Schedule to the principal regulations is amended -

(a)

by deleting all the words from "offence of using" to "those by-laws on -" and substituting the following -

offence of -

(3) Form 3 in the Schedule to the principal regulations is amended on the hack of the

form by inserting after "By-laws 1981" the following
