Water Agencies (Charges) Amendment
By-laws 2013
Made by the Minister under section 34 of the Act.
1. Citation
These by-laws are the Water Agencies (Charges) Amendment
By-laws 2013.
2. Commencement
These by-laws come into operation as follows —
(a) by-laws 1 and 2 — on the day on which these by-laws are published in the Gazette; (b) the rest of the by-laws — on 1 July 2013.
3. By-laws amended
garden purposes, in relation to the supply of water,
means the use of water for watering lawns and gardens
appurtenant to land, including lawns and gardens
growing in a street or road adjoining the land;
These by-laws amend the Water Agencies (Charges)
By-laws 1987.
4. By-law 2 amended
(1) In by-law 2(1) insert in alphabetical order:

(2) In by-law 2(1) in the definition of year:
(a) delete “1999/2000)” and insert: 1999/2000), subject to sub-bylaw (2A),
(b) in paragraph (b)(i) delete “31 October,” and insert: 31 August,
(c) in paragraph (b)(ii) delete “29 June” and insert: 30 June
(3) After by-law 2(1) insert: (2A) For the purposes of the definition of year, for the
2012/2013 year the period set out in paragraph (b)(i) is
to end on a day determined by the Corporation, being a
day no earlier than 8 months after the commencement
of the period.5. By-law 6 amended
Delete by-law 6(1) and insert:
(1) Where a charge is to be assessed by reference to the
quantity of water concerned and, because of a
circumstance specified in sub-bylaw (2A), an accurate
meter reading measuring that quantity cannot be
obtained the charge is to be assessed by reference to a
quantity of water estimated by the Corporation —
(a)
by reference to a daily average of the quantity of water supplied in another period; or

(b)
by adjusting the quantity registered by the meter to take account of an error found on testing the meter; or
(c)
on such other basis as the Corporation may determine.
(2A) For the purposes of sub-bylaw (1), the following
circumstances are specified —
(a) the meter is found not to be in proper order; (b) the meter has been removed for repair; (c) a physical obstruction, adverse weather or other access to the meter;
(d) the meter cannot be read because the face of the meter is obscured by damage, marking, dirt or any other substance.
6. By-laws 7, 7A and 7B replaced
Delete by-laws 7, 7A and 7B and insert:
7. Payment of charges
(1) In this by-law — annual charge means a charge other than a quantity
charge or an industrial waste charge;industrial waste charge means a charge under
Schedule 3 Division 1 item 6 or 7 or Division 3 or 6.(2) A charge, or a portion of a charge, is due for payment
to the Corporation on the day specified in an invoice
for the charge or the portion.

(3) The day specified must be —
(a)
for an industrial waste charge or a single capital infrastructure charge — at least 28 days after the day on which the invoice is issued; or
(b)
for all other charges — at least 16 days after the day on which the invoice is issued.
(4) An annual charge may be due for payment, in whole or in part, in advance, but not before the beginning of the year for which the charge applies. (5) This by-law is subject to a special payment
arrangement under by-law 8.
7. By-law 8 amended
In by-law 8(4):
(a) delete paragraph (b); (b) in paragraph (c) delete “item 5.” and insert: item 2.
8. By-law 8A amended
In by-law 8A(2) delete “item 4” and insert:

9. By-law 9 replaced
Delete by-law 9 and insert:
9. Interest on overdue amounts
(1) For the purposes of section 41L —
(a)
the time from which interest is to be calculated on overdue amounts is one day after the amount was due and payable; and
(b)
interest is to be calculated at the rate set out in Schedule 7 item 2.
(2) For the purposes of the Land Drainage Act 1925
section 100B —
(a) the period prescribed is one day after rates become due and payable; and (b) interest is to be payable at the rate set out in Schedule 7 item 2.
10. By-law 9A deleted

19. Formula for quantity charge
For the purposes of Division 4, the quantity charge (Q) is

F = the volume of water delivered to the property in the
2013/2014 year;G = the discharge factor set for the property for the 2013/2014
year;H = the discharge allowance for the 2013/2014 year calculated

20. Discharge allowance
For the purposes of item 19, the discharge allowance is —
(a) for land to which item 13 applies that is not mentioned in paragraph (e), 200 kL of water; and (b) for a non-commercial Government property, or a property held by a Government trading organisation, 200 kL of water; and (c) for a caravan park referred to in item 15, an amount of water in kilolitres calculated in accordance with the following formula — L + M
