Water Agencies (Powers) Act 1984
Water Agencies (Charges) Amendment
By-laws 2012
Made by the Minister under section 34 of the Act.
1. Citation
These by-laws are the Water Agencies (Charges) Amendment
By-laws 2012.
2. Commencement
These by-laws come into operation as follows —
(a) by-laws 1 and 2 — on the day on which these by-laws are published in the Gazette; (b) the rest of the by-laws — on 1 July 2012.
3. By-laws amended
These by-laws amend the Water Agencies (Charges)
By-laws 1987.
4. By-law 2 amended
(1) In by-law 2(1) delete the definition of home for the aged.

(2) In by-law 2(1) insert in alphabetical order: aged home means an institution that, in the opinion of
the Corporation —
(a) provides accommodation for aged persons; and (b) is not operated for the purpose of profit or gain;
(3) In by-law 2(1) in the definition of year delete paragraph (b)(iii)
and insert:(iii) that relates to industrial waste discharged under the Metropolitan Water Supply, Sewerage, and Drainage Act 1909 or the Country Towns
Sewerage Act 1948, the period commencing on a day determined by the Corporation, being a day between 15 June and 15 July in the first of the years referred to and ending on a day determined by the Corporation, being a day between 15 June and 15 July in the second of the years referred to; and
5. By-law 5A inserted
After by-law 4 insert:
5A. Exempt land, amount of exemption calculated
(1) In this by-law — exempt land means land —
(a)
which is exempt from a charge for a water service; or
(b)
for which a discount is prescribed for a water service.

(2) The Corporation may provide a person with an account
in respect of exempt land showing the charge that
would have been payable for a water service if the
exemption or discount did not apply.(3) For the purposes of the definition of exempt land
paragraph (a) in this by-law, the amount of the
exemption is to be calculated by reference to the
quantity of water or wastewater concerned or the gross
rental value, unimproved value or area of the land in
respect of which the water service is provided.6. By-law 9B amended
In by-law 9B(1) delete “13.0%” (each occurrence) and insert:
13.6%
7. By-law 12 amended
In by-law 12(2) after “Schedule 1” insert:
to the extent set out in that Schedule
8. By-law 13 amended
(1) In by-law 13(1):
(a) delete paragraph (h) and insert:

aged home, if the land is in the metropolitan area and the classification of the land is not otherwise specifically provided for in this
by-law.
(2) After by-law 13(1) insert: (2A) For the purposes of this Division, land described in
by-law 4 that is —
(a) provided with a water supply connection; and (b)
not otherwise classified under sub-bylaw (1),
is classified as community purpose irrespective of any
other classification under these by-laws.
9. By-law 17C amended
In by-law 17C(3) delete “13.0%” (each occurrence) and insert:

10. By-law 22 amended
In by-law 22 delete “Schedule 3.” and insert:
Schedule 3 to the extent set out in that Schedule.
11. By-law 23 amended
In by-law 23(1):
(a) in paragraph (c) delete “them,” and insert: them;
(b) after paragraph (c) insert:
