Water (Part 2—General) Amendment

Regulation 1998

Water Act 1912

His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Water Act 1912.

Explanatory note

The objects of this Regulation are as follows:

(a)	to exclude certain streams of water from the definition of “river” for the purposes of the Water Act 1912,
(b)	to decrease the fees for transfer of water allocations (from $90 to $75 for temporary transfers, and from $275 to $250 for other transfers),
(c)	to increase the maximum charge for certain rights to take and use water, the flow of which is managed by the State or assured by the work of the Crown, and to prescribe the domestic use of such water as giving rise to a charge in certain circumstances.

This Regulation is made under the Water Act 1912, including sections 5 (l), 20AJ, 22C (3) and (4), and section 27 (the general regulation-making power for the purposes of Part 2 of the Act).

Regulation 1998.

1. Amendment of Water (Part 2—General) Regulation 1997

   The Water (Part 2—General) Regulation 1997 is amended as set out in Schedule 1.

The explanatory note does not form part of this Regulation.

Insert after clause 5:

5A Streams of ater not within definition of “River”

For the purposes of the definition of River in section 5 (1) of the Act, the following streams of water are prescribed as not being rivers:

Barratta Creek, as shown on Central Mapping Authority map entitled “Morago 7827-II & III” (First Edition 1:50 000 Topographic Series)

Box Creek Escape Channel, as shown on Central Mapping Authority map entitled “Morago 7827-II & III” (First Edition 1:50 000 Topographic Series)

[2]       Clause 12 Fees for transfer of water allocations

Omit “$275” from clause 12 (1) (a). Insert instead “$250”.

[3]       Clause 12 (1) (b)

Omit “$90”. Insert instead “$75”.

[4]       Clause 13 Maximum charges under section 22C of the Act

Omit “$14.50”. Insert instead “$21”.

[5]       Clause 30 Prescribed uses under section 22C of the Act

Insert after clause 30 (c):

(d) domestic.
