Water (Part 2) Amendment

(Transfers) Regulation 1996

His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Water Act 1912.

Explanatory note

Under section 20AI (3) of the Water Act 1912, an application for the temporary transfer of a volumetric water allocation may be made so long as the transfer of the water allocation is for a period of not more than 3 years (or some other period prescribed by the regulations). The object of this Regulation is to prescribe 5 years as the maximum period in respect of temporary transfers of water allocations.

This Regulation is made under the Water Act 1912, including sections 20AI and 27 (the general regulation making power for the purposes of Part 2 of the Act).

Clause 40B

Insert after clause 40A:

40B Prescribed period for temporary transfer of water

allocations

For the purposes of section 20AI (3) (a) of the Act, the period of 5 years is prescribed.
