WATER ACT 1912 - REGULATION
(Relating to the payment of rates and charges)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Water Act 1912, has been pleased to make the Regulation set forth hereunder.

Amendment of Water (Part 6) Regulations
1. The Water (Part 6) Regulations are amended:
| (a) | by omitting Regulation 3 and by inserting instead the following Regulation: |
Payment of rates and charges
3. (1) An owner or ratable person in respect of a holding within a district constituted under Part 6 of the Water Act 1912 is to be notified by means of a notice of assessment of:
(a)
the rates and charges fixed by the Ministerial Corporation for the current year for water rights attached to such holdings; and
(b)
the amount payable by the owner or ratable person, in respect of the water rights attached to the holding, for the period to which the notice relates; and
(c)
the amount payable by the owner or ratable person, for water supplied in excess of the water supplied pursuant

to the water rights attached to the holding, for the period
to which the notice relates.(2) The amounts specified in the notice are to be paid to the Ministerial Corporation on or before the date for payment specified in the notice, which date must not be less than 28 days after the date of issue of the notice.
(3) If an owner or ratable person first becomes liable to a rate or charge after 1 July in any year, the amount of the rate or charge is to be apportioned for the period from the date from which the rate or charge becomes payable until 30 June next following on the basis of such proportion of the rate or charge as that period bears to the whole year.
(b) by omitting Regulation 5 (2);
(c) by omitting Forms 1 and 2 from the Schedule.
Amendment of Water (Part 7) Regulations
2. The Water (Part 7) Regulations are amended:
(a) by omitting Regulation 2 and by inserting instead the following Regulation: Payment of rates
2. (1) An owner or ratable person in respect of a holding within a district constituted under Part 7 of the Water Act 1912 is to be notified by means of a notice of assessment of:
(a) the rate fixed by the Ministerial Corporation for the current year; and (b) the amount payable by the owner or ratable person, in accordance with that rate (subject to any variation by the Ministerial Corporation), for the period to which the notice relates.
(2) The amount specified in the notice is to be paid to the Ministerial Corporation on or before the date for payment specified in the notice, which date must not be less than 28 days after the date of issue of the notice.
(3) If an owner or ratable person first becomes liable to a rate after 1 July in any year, the amount of the rate is to be apportioned for the period from the date from which the rate becomes payable until 30 June next following on the basis of

such proportion of the rate as that period bears to the whole
year.
(b) by omitting Regulation 4 (b);
(c) by omitting the Schedule.
EXPLANATORY NOTE
The object of this Regulation is to amend regulations under the Water Act 1912
to provide for the periodic assessment and payment of rates for water.
The proposed schemes replace schemes that provide for assessment and payment
of water rates on an annual basis.
