HEREAS it is expedient to further amend "The Waste Lands Preamble.

W Amendment Act, 18689," by providing for the payment, by

two instalments, of the arnoiznt of deposit payable on account of

the prchase moncy of lands sold under the said Act, and by re-

pealing so much of the Act as requires that a description of the lands intended to be proclaimed, under the said Act, as an agri- cultural arm, shall be laid before Parliament fourteen days at the least prior to the Proclamation of any such area, and in manner hereinafter provided-Be it therefore Enactccl, by the Governor of

the Province of South Australia, with thc advicc and consent of

the Legislative Council and Wousc of Assembly of the said Yrovince,

in this present Parliament assembled, as follows:

1. From and after the passing of this Act any person or persons Interest to be paid in

who shall purchase waste lands of the Crown, either at auction or two instalment^ thing in such last-mentioned Act to the contrary notwithstandini),

otherwise, under the provisions of the Waste Lands Amendment

at the time of making snch purchase, pay a sum of Ten Pounds per

centum on the amount of such person clr persons' purchase-money7 in lieu and in stead of the sum of Twenty Pounds per centum an such purchase-money, as provided by the said Act. ; and such person or persons so making the payment hereby authorized shall, on the ex- piration of three years from the date of making wch last-named

deposit, pay a further sum of Ten Pounds per centum on the amount of such purchasemoney: And the making of such two payments together shall be deemed to be a complete compliance by such person or persons with the terms of the said Act, so far as regards the payment of the interest required by such Act.

Definition of terns.

3, The followiag terms within inverted commas shall, in the con-

struction of " The Waste Lands Amendment Act, 1868-9," unless

the context otherwise indicates, bear the meaning set against them

respectively :-

'L Occupy" or L' occ~~pation"-TO residc or residence upon the land

selected:

Cultivation" or " cultivatev-Ploughing

, digging, or trenching,

and planting cereal or root crops; an orchard, vineyard, or

nursery:

Provided that nothing in this clause shall affect any contract or agreement entered into before the passing of this Act.

4. The period during which tllo lands shall be open for selection at each separate period shall not be less than seven days nor more than two months, in lieu of the periods of one month and three months in the seventh clause of the said Waste Lands Amendment Act, 1868-9," mentioned.

Incorporation.

5. This Act and "The Waste Lands Amendment Act, 1868-9,"

save and in so far as the same last mentioned Act is not hereby repealed, altered or amendcd; and an Act to amend the "Waste Lands Amendment Act, 1868-9," No, 4 of 1869-70, shall be deemed to be incorporated with this Act, and shall be read together as one Act.
