Amendment Regulations 2020

Made by the Governor in Executive Council.

1.   Citation

These regulations are the Waste Avoidance and Resource

Recovery Levy Amendment Regulations 2020.

2.   Commencement

These regulations come into operation as follows —

(a)	regulations 1 and 2 — on the day on which these regulations are published in the Gazette;
(b)	the rest of the regulations — on the day after that day.

3. Regulations amended

These regulations amend the Waste Avoidance and Resource

Recovery Levy Regulations 2008.

4. Regulation 5 amended

(1) In regulation 5(1):

(a)	delete "in an approved form";
(b)	delete paragraph (a) and insert:

(a) waste that —

(i)      was accepted by the licensee at no charge; and

(ii)    is, or will be, used after the completion

disposed of at the licensed landfill in
compliance with the conditions on the
licence or any implementation
conditions as defined in the
Environmental Protection Act 1986

section 3(1);

(2)	In regulation 5(2) delete "in the approved form".
(3)	In regulation 5(3) delete "in an approved form".
(4)	After regulation 5(3) insert:

(3A) A licensee may by application claim an exemption

clean fill received at a licensed landfill before the day on which the Waste Avoidance and Resource Recovery	from these regulations for uncontaminated soil or other into operation if—
(a)	it was accepted by the licensee at no charge; and
(b)	it is, or will be, used after the completion of landfill operations to cover, to a depth of up to 500 mm, waste disposed of on the premises.

(313) An application under this regulation must -

(a)	be in the approved form; and
(b)	include or be accompanied by the information required by the CEO.

5.            Regulation 8 amended

In regulation 8(3) after "5(1)" insert:
