[ASSENTED TO 14TH DECEMBER, 1906.] W HEREAS William Ball Slade, Arthur Morgan, and Preamble. George Powell Barnes, all of Warwick, in the State of Queensland, are the registered proprietors in fee-simple, under " The Real Property Acts, 1861 to 1887," of a certain parcel of land situated in the county of Merivale, parish of Warwick, and town of Warwick, being subdivision three of allotment four of section twenty-two, containing nineteen and a- half perches, and which is more particularly described in Certificate of Title No. 38273, Volume 261, Folio 25, upon trust for the purposes of the Warwick School of Arts: And whereas by Bill of Mort- gage numbered 356077, and registered on the twenty- eighth day of February, one thousand nine hundred and one, the said land was mortgaged to the Australian Joint Stock Bank, Limited, to secure repayment of the sum of two hundred pounds and further advances with interest as therein stated : And whereas there is now due and owing to the said bank the sum of three hundred and fifty pounds or thereabouts in respect of the said mortgage: And whereas the said Trustees are desirous of selling the said land, together with the buildings erected thereon, and of devoting the proceeds arising from such sale to the redemption of the said mortgage and the purchase of a more commodious and suitable site and the building thereon of a new School of' Arts: And whereas it is expedient that such powers should be granted to the said Trustees, subject to the conditions hereinafter mentioned: Be it therefore enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows :- 1. This Act may be cited as " The Warwick School Short title. of Arts _Land Sale Act of 1906."

In this Act, the expression "the Trustees" means tion. and includes the said William Ball Slade, Arthur Morgan, and George Powell Barnes, and their successors. :Tower to sell. 3. (1.) The Trustees, at any time after the passing of this Act, may sell the said parcel of land, together with the buildings erected thereon, by public auction or private contract, and either for cash or on credit or partly for cash and partly on credit; and on payment of the purchase money into the hands of the Trustees they shall transfer the said land to the purchaser, and such transfer shall be valid and effectual in law for all purposes. (2.) in the case of a sale by auction, the Trustees shall give due notice thereof by advertisement in a news- paper published at Warwick aforesaid at least fourteen days before the date of such sale, and the Trustees may insert any special or other stipulations in the conditions of sale as they think fit. Application of proceeds. 4. Upon receipt of the money realised by such sale, the Trustees shall, in the first place, pay the reasonable expenses of such sale and the costs, charges, and expenses of and attending the applying for and obtaining and passing of this Act; and shall, in the next place, repay to the said bank the sums then owing in respect of the said mortgage of the said land, and shall deposit the remainder of the purchase moneys in the Australian Joint Stock Bank, Limited, at Warwick, and shall not withdraw the same or apply any part thereof for any purposes except for the purchase of another parcel of land and for defraying the cost of ereCting thereon and furnishing buildings suitable for the purposes of a School of Arts. And the Trustees shall hold the land and property so to be purchased and acquired upon trust for the purposes of the Warwick School of Arts, and for no other purpose whatsoever. SOUTH BRISBANE.
