The following local environmental plan is made by the local plan-making authority under the

Environmental Planning and Assessment Act 1979.

1      Name of Plan

This Plan is Warrumbungle Local Environmental Plan 2013 (Amendment No 2).

2      Commencement

This Plan commences on the day on which it is published on the NSW legislation website.

3      Land to which Plan applies

This Plan applies to land to which the Warrumbungle Local Environmental Plan

2013 applies.

4      Maps

The maps adopted by Warrumbungle Local Environmental Plan 2013 are amended or replaced, as the case requires, by the maps approved by the local plan-making authority on the making of this Plan.

5 Amendment of Warrumbungle Local Environmental Plan 2013

(1) Clause 4.2C

Insert after clause 4.2B:

4.2C	Erection of dwellings on land affected by Wambelong Fire
(1) The objective of this clause is to enable the replacement and repair of lawfully erected dwellings damaged by the Wambelong Fire. (2) This clause applies to land identified on the Wambelong Fire Dwelling Map.

(3)

Development consent may be granted to the erection or alteration of, or an addition to, a dwelling on land to which this clause applies if the consent authority is satisfied that the development is to replace or repair a dwelling damaged by the Wambelong Fire.

(4)

For the purposes of this clause, Wambelong Fire means the fire that

occurred in January 2013 in and around the Wambelong Valley.

Insert in appropriate order:
Wambelong Fire Dwelling Map means the Warrumbungle Local Environmental
Plan 2013 Wambelong Fire Dwelling Map.
