I, the Minister for Planning, make the following local environmental plan under the

Environmental Planning and Assessment Act 1979.

1      Name of Plan

This Plan is Warrumbungle Local Environmental Plan 2013 (Amendment No 1).

2      Commencement

This Plan commences on the day on which it is published on the NSW legislation website.

3      Land to which Plan applies

This Plan applies to land in Zone RU1 Primary Production under Warrumbungle

Local Environmental Plan 2013.

4 Amendment of Warrumbungle Local Environmental Plan 2013

(1)

Clause 4.2A Erection of dual occupancies and dwelling houses on land in Zone

RU1

Insert after clause 4.2A (3) (a):

(aa)

is a lot that:

(i)

is at least the minimum lot size shown on the Minimum Lot Size—Dwelling House and Dual Occupancy Map in relation to that land, and

(ii)

was created before this Plan commenced, and

(iii)

does not consist of any land that formed part of an existing holding immediately before this Plan commenced, or

(2)

Clause 4.2A (3) (e)

Insert “(aa),” after “(a),”.

Clause 4.2A (3A)

Insert after clause 4.2A (3):

(3A)

Subclause (3) (aa) does not have any operation in relation to any development application made 5 years after the date on which that paragraph commenced.
