An Act to amend the Warehousemen’s Liens Act 1935 in relation to the sale of goods under that Act (Assented to 14 December 1989]

The Legislature of New South Wales enacts:

Short title

1. This Act may be cited as the Warehousemen’s Liens

(Amendment) Act 1989.

Commencement

2. This Act commences on a day to be appointed by proclamation. Amendment of Warehousemen’s Liens Act 1935 No. 19, s. 6 (Power to sell goods)

3. The Warehousemen’s Liens Act 1935 is amended by omitting

section 6 (7) and by inserting instead the following subsection:

(7)

Nothing in this section authorises:

(a)

the Warehousemen’s Liens (Amendment) Act 1989, unless the sale of goods deposited prior to the commencement of

at least some part of the charges in arrears relates to a period more than 12 months before the date on which the notice of intention to sell the goods is given; or

the sale of goods deposited after the commencement of that Act, unless at least some part of the charges in arrears relates to a period more than 6 months before the date on which the notice of intention to sell the goods is givea
