| WH E R E A S obtained in order t h a t t he parcel of land described in the | Schedule hereto together wi th the bui ldings thereon erected may be |
| effectually vested in H e r Majes ty for t he purposes of this Ac t freed and discharged from any t rus t s express implied or construct ive which migh t be deemed to be annexed there to and to indemnify the Council of the said Borough in respect of any breach of t rus t which they migh t be deemed to have commit ted in respect of the surrender of or the ag reement to surrender the said parcel of land to H e r Majes ty Be it therefore enacted by the Queen ' s Most Exce l len t Majesty by and wi th the advice and consent of the Legislat ive Council and Legislative Assembly of N e w South Wales in Par l i ament assembled and by the au thor i ty of the same as follows :— | |
| 1. Upon t h e passing of this A c t t he parcel of land des cribed in the Schedule hereto together wi th all bui ld ings erected thereon shall for the purpose of be ing used as a Court House vest in H e r Majesty her heirs and successors for an estate of fee simple of inher i tance in possession freed and discharged from all t rus ts whether express implied or constructive which migh t be deemed to be annexed to t he Council of the Borough of W a r a t a h or to any other persons in respect of such parcel of land And the said Council and persons are hereby indemnified in respect of any breach of t rus t which t hey migh t be deemed to have commit ted in respect of t he surrender or agreement to surrender hereinbefore referred to A n d all contracts agreements liabilities obligations rights-of-way and all other easements whatsoever heretofore incident to or which m i g h t be deemed to be a charge upon t h e said parcel of land whe ther a t law or in equi ty are hereby ext inguished and annul led. |

| of six h u n d r e d pounds being the s u m originally agreed to be paid as purchase money for the said land and which said s u m was appropriated by Pa r l i amen t by t he Appropriat ion Act forty-one Victoria n u m b e r twenty-four for the purchase of t he said parcel of land and there in directed to be paid t o t he said Council shall be paid by t h e Colonial Treasurer to t he Council of the said borough or to such bankers corporation or other persons as may by wr i t ing unde r t he hands of t he Mayor and any two Aldermen of t he said Borough and counter- signed by the Council Clerk thereof be appointed to receive the same A n d the paymen t of t he said s u m by t h e said Treasurer in terms of th is section shall be a full and complete discharge to h i m and to H e r Majes ty in respect of the said sum and the applicat ion thereof. | S C H E D U L E . |
