SOUTH AUSTRALIA

WAR TERMS REGULATION ACT, 1920 WAR TERMS REGULATION ACT, 1920

An Act to regulate the use of certain war terms in connection with trade or business, and for

other purposes.

BE IT ENACTED by the Governor of the State of South Australia, with the advice and consent of the Parliament thereof, as follows:

Short title

1. This Act may be cited as the War Terms Regulation Act, 1920.

Definition of "prohibited word"

2. In this Act "prohibited word" means—

(a) the word "Anzac" or any word resembling the word "Anzac"; or

(b)

the word or expression "Aussie", "returned soldier", "returned sailor", "repatriation", "Australian Imperial Force", "A.I.F."; or

(c)

any word or expression associated with the recent war which is declared by the Governor, by notification in the Government Gazette, to be a prohibited word for the purposes of this Act.

Use of prohibited word

3. Any person who, unless he has first obtained the authority of the Minister of Repatriation, proof whereof shall lie upon the person accused—

(a) assumes or uses a prohibited word in connection with any trade, business, calling or profession; or
(b) uses a prohibited word as the name or part of the name of—
(i) any private residence; or
(ii) any boat or vehicle; or
(iii) any charitable or other institution or any building in connection therewith,

shall be liable to a penalty not exceeding two hundred dollars or to imprisonment for a term not exceeding three months or to both such penalty and such imprisonment, or if the offender is a corporation, to a penalty not exceeding four hundred dollars.

What is deemed to be use of prohibited word

4. Without limiting the meaning or operation of section 3, a word or expression shall be deemed to be assumed or used by a person in connection with a trade, business, calling, or profession if—

(a)

it is applied to any goods manufactured, produced, sold, or offered for sale by that person; or

(b)

it is used as the name, or part of the name, of any firm or company registered in South Australia.

Register of Companies to refuse registration of companies and firms using prohibited words

5. The Registrar of Companies shall refuse to register any company or firm in the name of which there is included any prohibited word, unless the person seeking to have such company or firm registered produces to the said registrar the written consent of the Minister of Repatriation to the registration of such company or firm.

Summary proceedings for offences

6. All proceedings in respect of offences against this Act shall be disposed of summarily.

Appeal

7. There shall be an appeal in respect of proceedings in respect of offences against this Act.

Special case

8. In the event of an appeal in respect of proceedings in respect of offences against this Act, a special case may be stated.
