War Service Land Settlement Acts Amendment Act of 1967
526 ANNO SEXTO DECIMO ELIZABETHAE SECUNDAE REGINAE No. 49 of 1967 An Act to Amend "The War Service Land Settlement Acts, 1946 to 1960," in certain particulars [ASSENTED TO 22ND DECEMBER, 1967] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows.- 1. (1) Short title . This Act may be cited as "The War Service Land Settlement Acts Amendment Act of 1967." (2) Principal Act. " The War Service Land Settlement Acts, 1946 to 1960," are in this Act referred to as the Principal Act.
War Service Land Settlement Acts Amendment Act of 1967, No. 49 527 (3) Collective title. The Principal Act and this Act may be collectively cited as "The War Service Land Settlement Acts, 1946 to 1967." 2. Amendments of s. 3. Section three of the Principal Act is amended by- (a) in the definition of " eligible person " adding the following proviso to the second subparagraph of paragraph (a):- t( Provided that this subparagraph does not apply in relation to a person specified in paragraph (i) of the definition of " Member of the Forces " ceasing to serve on special service but who is otherwise not discharged from the Forces;"; (b) in the definition " Member of the Forces "- (i) omitting the word " and " appearing immediately after paragraph (g); (ii) inserting after paragraph (h) the following word and paragraph:- " and (i) A person who while a member of the Defence Force served on special service;"; (c) inserting after the definition " Settler " the following definition:- " Special service "-in relation to any person means- (a) Special service within the meaning of the Repatriation (SpecialOverseas Service) Act1962-1966 of the Commonwealth or any Act amending the same or in substitution therefor; (b) Such service as the Governor in Council (who is hereby thereunto authorized) by Order in Council from time to time declares to be special service for the purposes of this Act;"; and (d) adding to the definition " War service " the following paragraph:- (f In the case of a person specified in paragraph (i) of the definition of " Member of the Forces ", special service subsequent to the first day of July, one thousand nine hundred and sixty-two;". 3. New s. 28A inserted . The Principal Act is amended by inserting after section twenty-eight the following section:- " [28A.] Publication of Order in Council . (1) Every Order in Council made under this Act shall- (a) Be published in the Gazette; (b) Upon its publication in the Gazette, be judicially noticed and such publication shall be conclusive evidence of the matters contained therein; and
528 War Service Land Settlement Acts Amendment Act of 1967, No. 49 (c) Be laid before the Legislative Assembly within fourteen sitting days after such publication, if the Legislative Assembly is in session, and sitting for the despatch of business and if not, then within fourteen sitting days after the Legislative Assembly again sits for the despatch of business. (2) If the Legislative Assembly passes a resolution of which notice has been given at any time within fourteen sitting days after any such Order in Council has been laid before it disallowing the same or part thereof, that Order in Council, or part shall thereupon cease to have effect, but without prejudice to the validity of anything done in the meantime or to the making of any further Order in Council."
