    An Act to authorize the Variation of certain trusts under the Will of the late Walter Oswald Watt

    WHEREAS by his Will dated the fifteenth day of January, One thousand nine hundred and twenty, Walter Oswald Watt, late of Sydney, in the State of New South Wales, bequeathed the sum of Five hundred pounds to the Commandant for the time being of the Royal Military College, Duntroon, in the Territory for the Seat of Government of the Commonwealth, on trust to invest the same and to apply the income accruing therefrom to the purchase in each year of a pair of field glasses to be given as a prize to the cadet who in that year writes the best essay dealing with any aspect of military aviation or aeronautics:

    AND WHEREAS the said sum of Five hundred pounds (together with accretions thereto) has been duly invested and the income therefrom is more than sufficient to purchase one pair of field glasses in each year:

    AND WHEREAS it is desirable to make provision for the application of the surplus income:

    BE it therefore ordained by the Administrator of the Government of the Commonwealth of Australia, with the advice of the Federal Executive Council, in pursuance of the powers conferred by the Seat of Government Acceptance Act 1909-1938 of the Commonwealth and the Seat of Government (Administration) Act 1910-1933 of the Commonwealth, as follows:

    Short title

    1.  This Act may be cited as the Walter Oswald Watt Memorial Fund Act 1938.1

    Interpretation

    2.  In this Act, unless the contrary intention appears—

    “the College” means the Royal Military College at Duntroon, in the Australian Capltal Territory;

    “the Fund” means the sum of Five hundred pounds (together with accretions thereto) referred to in the Preamble to this Act;

    “the income” means the income arising from the investment of the Fund, and includes accrued income;

    “the Will” means the Will of the late Walter Oswald Watt which is referred to in the Preamble to this Act.

    Application of excess income

    3.  Where, in any year, the income is more than sufficient to purchase one pair of field glasses, the amount of the excess income, or any part thereof, may be expended on the purchase of a second pair of field glasses to be given as a second prize to the cadet attending the College who in that year writes the second best essay dealing with any aspect of military aviation or aeronautics.
