The challenge to the powers of the Planning and Environment Court to grant declaratory relief has insufficient prospects of success to warrant the grant of special leave. Neither challenge to the construction of the application for the planning approval and the planning approval involves any issue of principle. And the argument concerning the possible contravention of the Anti‑Discrimination Act 1991 (Q) was unnecessary for the determination of the case against the applicant.
The application for special leave to appeal should be refused.
Pursuant to r 41.08.1 we direct the Registrar to draw up, sign and seal an order dismissing the application with costs.
