number one hundred and twenty-four situate in the parish of Botany and eounty of Cumberland and containing thirty acres two roods and tw'cnty-eight perehes or thereabouts was together Avith other lots of the said lands on or about the sixteenth day of March in the year one thousand eight hundred and seventy-seven adA'crtised in the Gazette for sale by public auction at Sydney liy direction of Ilis Excellency Sir Hercules llobinson the then Governor of the Colony but Avas AvithdraAvn fi’om sale and subsequently again adA'ertised for sale in like manner on tlie twenty-sixth day of May in the year one thousand eight hnndred and eighty and aaus again AvithdraAvn from sale but on or about the sixteenth day of December in the year one tbousand eiglit hundred and eighty-one Avas finally put up for sale by public auction in Sydney and AÂas purebased by John Walsh of Botany for the snm of Nine thousand tAvo hundred and three pounds ten shillings AAdiich sum aaus liy him duly paid into the Colonial Treasury pursuant to the conditions of sale And AAdiereas subsequently to the aforesaid direction of Sir Hercules llobinson an Act AA'as passed and after reservation for Her Majesty’s assent became laAV on the nineteenth day of October one thousand eight hundred and eighty-one under the title of “ A n Act to declare the entire management and control o f the lands commonly knoivn as the ‘ Church and School Lands' and the appropriation o f the income derived therefrom vested in the Legislature o f this Colony and that from and after the thirty-first day o f December one thousand eight hundred and eighty-two all such lands and income shall be respectively held and applied fo r the purposes o f Dublic Lnstruction only ” and by the said Act it is enacted that affi'r the passing thereof no portion of the lands described in tbc Schedule thereto comprising the said portion number one Imndred and t\A’cnty- four should be alienated but it is further by the said Act enacted that nothing therein contained shall be deemed to prejudice or affect any lease or agreement for a lease or other ol)ligation affecting any of the unsold lands described in the said Schedule And Avhereas doubts have arisen whether the aforesaid direction of Sir Hercules llobinson con stitutes an ol)ligation affecting tbc said portion of land Avitliin the meaning of the fourth section of the said Act and it is expedient to remove such doubts by authorizing the issue of a grant of the said portion to the purchaser thereof the said John 'Walsh Be it tliercforo enacted by the Queen’s Most Excellent Majesty by and Avitli the advice and consent of the Legislative Council and Legislative Assembly of Noav South IVales in Parliament assembled and by the authority of the same as folloAA's ;—
