TTTHEREAS, in aceordamu' with llu; provisions of IJic Public Preamble.

"Works Act, 1900, tlic Legislative' Assembly did, by resolution, declare that it Was expedient to cany out a certain work, namely, tbe construction of a tramway from Wallsend to West AYallsend ; And wdicreas on tbe pa.ssing of t!u' .said resolution, a statutory duty was by tbe said Act imposed on tin; Se'cretary for Public AA'orks to introduce a Bill into tbe said Assembly to sane!ion the carrying out of tbe said work: Be it therefore enacted by Ibc King’s Most Excellent Majesty, by and with the advice and consi'nt of the Lc'gislativc Council and Legislative Assembly of Acw South AYales in Parliament assembled, and by the authority of the same, as follows: —

2. The carrying out of the work (more particularly described in Work .sauctbjued.

the Scbedulc to this Act) is hereby sanctioned; and the Secretary for Public AVorks, or tbe Memlter of tint Executive Council for the tinu' being performing the duties of tbe. said Secretary, is hereby authorised to undertake and carry out the said w'ork, subject to tbe provisions of this Act, and for that purpose shall be and shall have the powers and duties of a Constructing Authority within tbe meaning of tbe Public AVorks Act, 1900.

3. Tbe plan of the said work is the plan markcvl “ Wallscnd to Plan of work.

AAmst AÂ allsend Tramway,” signed by tbe Secrclary for Public AA'orks, and countersigned by the Chief Engineer for Railway and Tramway Construction, and deposited in the public offici' of tbe said Secretary.

4. The cost of carrying out the said work, estimated at Cost, iiow t« bo

thirty-seven thousand and seventy-live pounds, exclusive of cost of resumptions and rolling stock, may be del'rayi'd from such Loan Azotes as arc now or may hereafter bc applicable to that purpose, or from ai)i)ropriations of the Public AVorks Eund, or partly from such votes and partly from the said appropriations, and shall not under any circumstances exceed tbe estimated cost by more than ten per centum.
