Application for approval of the Enterprise Agreement, Ground Masters & The Employees 2010-2014.

[1] On 30 December 2009, Wakefield Enterprises Pty Ltd made application for approval of a single enterprise agreement to be known as the Ground Masters & The Employees Enterprise Agreement 2010-2014 (“the Agreement”). The application was made pursuant to s.185 of the Fair Work Act 2009 (“the Act”).

[2] The Agreement was approved by ballot which concluded on 23 December 2009.

[3] Fair Work Australia must approve an enterprise agreement pursuant to s.186 of the Act if the requirements set out in that section, s.187 and s.188 are met.

[4] This application was the subject of a conference on 25 May 2010 where I raised a number of issues with the Applicant. The Applicant was requested to consider my concerns and provide any additional information to assist in my consideration of the application. My Associate communicated with the Applicant on 22 June 2010. No response was received.

[5] I am not satisfied from the material which I have been provided that ss.187 and 188 of the Act as are relevant to this application have been met, and accordingly, I am unable to approve the Agreement.
