1      Name of Plan

This Plan is Wagga Wagga Local Environmental Plan 2010

(Amendment No 7).

2      Commencement

This Plan commences on the day on which it is published on the NSW legislation website.

3      Land to which Plan applies

This Plan applies to the land to which Wagga Wagga Local

Environmental Plan 2010 applies.

Environmental Plan 2010

[1]      Clause 7.3 Biodiversity

Omit clause 7.3 (2). Insert instead:

This clause applies to land identified as “Biodiversity” on the

Terrestrial Biodiversity Map.

[2]      Clause 7.4 Vulnerable land

Omit clause 7.4 (2). Insert instead:

(2)

This clause applies to land identified as “Vulnerable Land” on the

Vulnerable Land Map.

[3]      Clause 7.5 Riparian lands and waterways

Omit clause 7.5 (2). Insert instead:

(2)

This clause applies to all of the following:

(a)

land identified as “Water” on the Water Resource Map,

(b)

land identified as “Waterway” on that map,

(c)

all land that is within 40 metres of the bank or shore (measured horizontally from the top of the bank or shore) of each waterway on land identified as “Waterway” on that map.

[4]      Clause 7.6 Groundwater vulnerability

Omit clause 7.6 (2). Insert instead:

This clause applies to land identified as “Groundwater” on the

Water Resource Map.

[5]      Dictionary

Insert the following in alphabetical order:

Terrestrial Biodiversity Map means the Wagga Wagga Local

Environmental Plan 2010 Terrestrial Biodiversity Map.

Vulnerable Land Map means the Wagga Wagga Local

Environmental Plan 2010 Vulnerable Land Map.

Water Resource Map means the Wagga Wagga Local

Environmental Plan 2010 Water Resource Map.
