I, the Minister for Planning, make the following local environmental plan under the

Environmental Planning and Assessment Act 1979.

1      Name of Plan

This Plan is Wagga Wagga Local Environmental Plan 2010 (Amendment No 13).

2      Commencement

This Plan commences on the day on which it is published on the NSW legislation website.

3      Land to which Plan applies

This Plan applies to the land to which Wagga Wagga Local Environmental Plan

2010 applies.

4      Maps

The maps adopted by Wagga Wagga Local Environmental Plan 2010 are amended or replaced, as the case requires, by the maps approved by the Minister on the making of this Plan.

Amendment of Wagga Wagga Local

Environmental Plan 2010

[1]      Clause 4.2A Erection of dwelling houses and dual occupancies on land in certain residential, rural and environmental protection zones

Insert after clause 4.2A (3) (c):

(c1) a lot resulting from a subdivision for which development consent (or equivalent) was granted before Wagga Wagga Local Environmental Plan 2010 (Amendment No 13) commenced and on which the erection of a dwelling house or dual occupancy would have been permissible if the plan of subdivision had been registered before that commencement, or

Insert after clause 7.7:

7.8 Cartwrights Hill Precinct—odour and noise assessment

(1)

The objective of this clause is to ensure that any odour and noise impacts from the Bomen industrial area and the Bomen sewage treatment facility are considered in determining the suitability of development within the Cartwrights Hill Precinct.

(2)

This clause applies to land identified as the “Cartwrights Hill Precinct” on the

Cartwrights Hill Precinct Map.

(3)

Development consent must not be granted for development on land to which this clause applies unless the consent authority has considered the potential impacts of odour and noise from the Bomen industrial area and the Bomen sewage treatment facility on the development.
