I can now come to the question whether I am satisfied that the qrounds relied upon in each notice h w e been established. T approach that task by considering arounds 1 tlr, 5 first of all. There are firstly some general matters to be mentioned. A5 earlier said. Mr. Wehbe. Mr. Martin and Mr. Bedworth were not

c3lled to aive evidence. Evidence was led on behslf of Caltex cf

at-tevpts made at various times to serve subpoenas u p o ~ Mr. F.arti?

and MY. Bedworth.

For reasons which need not be mentioned. these

attempts failed. But it should be said

that Caltex did its

utmost to have these witnesses available to be examined.

that Mr. Wehbe was a person who was likely to have had knowledqe of the circumstances i n which the various deliveries of fuel or distillate were made. His fallure to uive evidenre dnes mean that inferences which are open on the face of the Caltex case may the more readily be drawn.

The next matter I mentlon is that in

as it may, the evidence of Constable Crowleg does establish that

the quantity delivered on 3 Jlune 1986, before he stowped the

discharqe and caused Mr. Bedworth to be arrested. was 1,000

litres.
