Vocational Education and Training

(TAFE Qualifications) Act 2003†

[Assented to 13 May 2003]

The Parliament of Victoria enacts as follows:

1. Purposes

The main purposes of this Act are to amend—

(a) the Vocational Education and Training Act 1990 to enable TAFE Colleges to conduct courses in higher education and issue higher education awards; and
(b)

the Victorian Qualifications Authority Act delegations to registered providers.

2. Commencement

This Act comes into operation on 30 June 2003.

3. Ministerial directions—higher education

After section 6(1) of the Vocational Education Act No.
and Training Act 1990 insert— 45/1990.

(a) offering and conducting courses of Act Nos

4. TAFE Colleges—higher education

After section 25(1)(ba) of the Vocational

Education and Training Act 1990 insert—

"(bb) to offer and conduct a course of study

leading to the conferral of a higher education
award within the meaning of the Tertiary
Education Act 1993 in accordance with that

Act; and

(bc) to confer a higher education award within the

meaning of the Tertiary Education Act 1993 in accordance with that Act; and".

5. Victorian Qualifications Authority—delegations

(a)

a vocational education and training course or a sequence of vocational education and training;

(b)

a further education course, other than a further education course leading to the issue of a higher education award

within the meaning of the Tertiary
Education Act 1993;

(c)

any part of a course referred to in paragraph (a) or (b)—

that the registered education and training
organisation provides or proposes to provide
to determine whether it should be registered
as accredited or continue to be registered as

accredited.".

6. Statute law revision

(1) In section 3 of the Victorian Qualifications

Authority Act 2000, in the definition of
"Department" omit ", Employment".

(2) In section 86 of the Vocational Education and Training Act 1990, for the definition of "TAFE provider" substitute—

' "TAFE provider" means a body registered

under section 23 of the Victorian

Qualifications Authority Act 2000.'.
