Amendment Regulations 2016
Made by the Governor in Executive Council.
1. Citation
These regulations are the Vocational Education and Training
(Colleges) Amendment Regulations 2016.2. Commencement
These regulations come into operation as follows —

These regulations amend the Vocational Education and Training
(Colleges) Regulations 1996.4. Regulation 11 replaced
Delete regulation 11 and insert:
11. Course fees for 2Ol7—Schedule 1
(1) The course fee for a course to be commenced by a
student in 2017 is as follows -
(a)
where only one unit is commenced - the relevant fee determined in accordance with Schedule 1 item 2, 3, 4 or 5 (the unit fee);
(b)
if more than one unit is to be commenced - the sum of the unit fees for each unit to be commenced.
(2) Subregulation (1) does not apply to a course or unit for
which there is a determination in force under
regulation 15A or 16A.
5. Regulation 12 amended
(1) Delete regulation 12(2) and insert: (2) The maximum amount of course fee payable for 2017 by a student who is not a secondary school aged person
is $7 860.
(2) Delete regulation 12(4) and insert:
(4) The maximum amount of course fee payable for 2017
by a student who is a secondary school aged person,
but not enrolled at school, is $420.
6. Regulations 14 and 15 inserted
After regulation 13 insert:14. Students in State care
(1) This regulation applies to a student who is not enrolled
in school but is in the care of the CEO within the of that Act.

(2) A course fee is not payable by a student to whom this
regulation applies, in the following circumstances -
(a) for the student under the School Education
where the compulsory school education period reaches 18 years of age - a course fee is not payable for a course undertaken by that student until that student reaches the age of 18 years;
(b) for the student under the School Education
where the compulsory school education period student reaches 18 years of age - a course fee is not payable for a course undertaken by that student for the remainder of the year in which that compulsory school education period applies.
15. Existing workers
(1) This regulation applies to a person -
(a) regarded as an existing worker under a Vocational Education and Training (General) Regulations 2009 Schedule 1 training contract; and (b) who is undertaking training; and (c) who is not an apprentice.
(2) The fees payable for 2017 by a person to whom this regulation applies are the fees applicable to category courses.
7. Regulation 18 amended
(1) In regulation 18(2)(c) delete "assistance (VET FEE-HELP), but
has not had an eligible application for VET FEE-HELP" and
insert:assistance, either VET FEE-HELP or a VET student loan, but has not had an eligible application for the VET FEE-HELP or the VET student loan
(2) After regulation 18(2) insert: (2A) A governing council may cancel the enrolment, for a
particular course, or particular units, of a person who is
enrolled at a college if it becomes apparent after the
21 days given in subregulation (1) that the student will
not receive funding either by VET FEE-HELP or a

8. Regulation 20A deleted
Delete regulation 20A.9. Regulation 23 amended
Before regulation 23(1) insert:(I AA) This regulation does not apply to a person undertaking or wishing to undertake a course at the Diploma or the Advanced Diploma level.
10. Schedule 1 replaced
Delete Schedule 1 and insert:
