The application does not raise any question of principle suitable for the grant of special leave and, contrary to the applicant's submission, the interests of the administration of justice are not engaged by the application.  Special leave is refused.  We are not persuaded it is appropriate to accede to the first respondent's application for a special costs order.

  2. Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal orders dismissing the application with costs.
