CaseChat Overview and Summary
The court found that the agreement met all the necessary requirements for approval. The applicant had provided written undertakings, which the court was satisfied would not cause financial detriment to employees or lead to substantial changes to the agreement. The bargaining representatives for the agreement had also notified their intention for the agreement to cover them, as required by section 183 of the Act. The court was satisfied that the agreement would cover these organisations, as stipulated by section 201(2) of the Act.
Based on the findings, the court approved the Bentleys Aged Care Enterprise Agreement 2016. The agreement will operate from 29 April 2016, with a nominal expiry date of 1 January 2019. This decision ensures that the agreement is legally binding and enforceable under the Fair Work Act 2009.
