Victorian Energy Efficiency Target Act 2007
Victorian Energy Efficiency Target Amendment (Revocation of Incandescent Lighting Provisions) Regulations 2022
The Governor in Council makes the following Regulations:

Part 1—Preliminary
1Objective
The objective of these Regulations is to amend the Victorian Energy Efficiency Target Regulations 2018 to remove activities relating to incandescent lighting from the activities that are prescribed for the purposes of section 15(1) of the Victorian Energy Efficiency Target Act 2007.
2Authorising provision
These Regulations are made under section 75 of the Victorian Energy Efficiency Target Act 2007.
3Commencement
(1)These Regulations (except Part 3) come into operation on the day on which these Regulations are made.
(2)Part 3 comes into operation on 1 February 2023.
4Principal Regulations
In these Regulations, the Victorian Energy Efficiency Target Regulations 2018[1] are called the Principal Regulations.
Part 2—Note regarding revocation of incandescent lighting provisions
5Schedule 2—Part 21 amended
In Schedule 2 to the Principal Regulations, after the heading to Part 21 insert the following note—
"Note
This Part will be revoked on 1 February 2023—see regulation 3(2) and Part 3 of the Victorian Energy Efficiency Target Amendment (Revocation of Incandescent Lighting Provisions) Regulations 2022.".
Part 3—Revocation of incandescent lighting provisions
6Definitions
In regulation 5 of the Principal Regulations, the definitions of compact fluorescent lamp, downlight, extra-low voltage lighting converter, IEC/TR 61341, incandescent GLS lamp, incandescent lamp, LED lamp with integrated driver, licensed electrician, non-integrated LED lamp, reflector lamp, tungsten filament lamp and tungsten halogen lamp are revoked.
7Prescribed activities
In regulation 10(1)(e) of the Principal Regulations, for "21" substitute "22".
8Determinations of ESC in relation to certain matters
In regulation 36 of the Principal Regulations—
(a)in subregulation (5)(b) omit "21,";
(b)in subregulation (6) omit "21,".
9New Division 3 of Part 4 inserted
After regulation 48 of the Principal Regulations insert—
"Division 3—Incandescent lighting
48ARemoval of items relating to incandescent lighting from ESC register
(1)Despite regulation 46, on the commencement of Part 3 of the Victorian Energy Efficiency Target Amendment (Revocation of Incandescent Lighting Provisions) Regulations 2022, products with the following category numbers are taken to be removed from the ESC register—
(a)21A;
(b)21B;
(c)21C;
(d)21D;
(e)21E;
(f)21F.
(2)As soon as practicable after the commencement of Part 3 of the Victorian Energy Efficiency Target Amendment (Revocation of Incandescent Lighting Provisions) Regulations 2022, the ESC must amend the ESC register to reflect the removal of items effected by subregulation (1).".
10Schedule 2 amended
Part 21 of Schedule 2 to the Principal Regulations is revoked.
11Schedule 3 amended
Clause 21 of Schedule 3 to the Principal Regulations is revoked.
12Schedule 4 amended
Clause 6 of Schedule 4 to the Principal Regulations is revoked.
