Victorian Energy Efficiency Target Amendment (Relevant Entity and Other Matters) Regulations 2013

The Governor in Council makes the following Regulations:

1Objectives

The objectives of these Regulations are—

(a)to amend the Victorian Energy Efficiency Target Regulations 2008 to—

(i)prescribe a person not to be a relevant entity for the purposes of the Victorian Energy Efficiency Target Act 2007; and

(ii)prescribe when a reduction in greenhouse gas emissions is taken to have occurred in relation to prescribed activities; and

(iii)make other minor and technical amendments; and

(b)to amend the Victorian Energy Efficiency Target Amendment (Prescribed Activities) Regulations 2013 to make a minor and technical amendment.

2Authorising provision

These Regulations are made under section 75 of the Victorian Energy Efficiency Target Act 2007.

3Commencement

These Regulations come into operation on 10 July 2013.

4Principal Regulations

In these Regulations, the Victorian Energy Efficiency Target Regulations 2008[1] are called the Principal Regulations.

5Time at which prescribed activity is undertaken

For regulation 7 of the Principal Regulations, substitute

"7   Time at which prescribed activity is undertaken and reduction in greenhouse gas emissions occurs

(1)For the purposes of section 17(1) of the Act, a prescribed activity referred to in regulation 6 is to be taken to have been undertaken at the time specified in Part C of the Schedule applying to that prescribed activity.

(2)For the purposes of section 17(2) of the Act, a reduction in greenhouse gas emissions that results from a prescribed activity referred to in regulation 6 is to be taken to have occurred at the time specified in Part C of the Schedule applying to that prescribed activity.".

6Conditions and circumstances under which a certificate cannot be created

In regulation 10 of the Principal Regulations, for "section 17(4)" (wherever occurring) substitute "section 17(3)(d)".

7Relevant entity

After regulation 12 of the Principal Regulations, insert

"12A   Relevant entity

For the purposes of the definition of relevant entity in section 3(1) of the Act, the State Electricity Commission of Victoria (ABN 58 155 836 293) is prescribed not to be a relevant entity.".

8Schedules—Heading to Part C

For the heading to Part C of Schedules 1 to 15, 17, 19 to 26, and 28 to 36 of the Principal Regulations, substitute

PART C—TIME AT WHICH ACTIVITY UNDERTAKEN AND REDUCTION IN GREENHOUSE GAS EMISSIONS OCCURS"".

9Definitions—Victorian Energy Efficiency Target Amendment (Prescribed Activities) Regulations 2013

In regulation 15(b) of the Victorian Energy Efficiency Target Amendment (Prescribed Activities) Regulations 2013[2], for "definition
of Be" substitute "definition of Bs".
