Victorian Energy Efficiency Target Amendment (Commercial and Industrial Air Source Heat Pump Water Heater) Regulations 2021

1Objective
The objective of these Regulations is to amend the Victorian Energy Efficiency Target Regulations 2018 to prescribe activities relating to air source heat pump water heaters for the purposes of section 15(1) of the Victorian Energy Efficiency Target Act 2007.
2Authorising provision
These Regulations are made under section 75 of the Victorian Energy Efficiency Target Act 2007.
3Principal Regulations
In these Regulations, the Victorian Energy Efficiency Target Regulations 2018[1] are called the Principal Regulations.
4Definitions
In regulation 5 of the Principal Regulations insert the following definitions—
"air source heat pump water heater means a heat pump water heater with an evaporator which collects latent energy and sensible heat from the atmosphere;
heat pump water heater means a water heater that uses a vapour compression cycle and which incorporates a compressor, an evaporator and a condenser that delivers heat to water either directly or indirectly;
licensed or registered plumber means a licensed plumber or registered plumber within the meaning of section 221B(1) of the Building Act 1993 who is authorised under that Act to carry out refrigerated air‑conditioning work as prescribed in the Plumbing Regulations 2018;".
5Prescribed activities
(1)In regulation 10(3)(c) of the Principal Regulations, for "43" substitute "44".
(2)After regulation 10(5) of the Principal Regulations insert—
"(6)For the purposes of section 15(1) of the Act, an activity set out in Part 44 of Schedule 2 is also a prescribed activity if it is undertaken in compliance with that Part in the common areas of a building that is classified under Part A6 of Volume One of the Building Code as a Class 2 building.".
6Schedule 2—New Part 44 inserted
After Part 43 of Schedule 2 to the Principal Regulations insert—
"Part 44—Commercial and industrial air source heat pump water heaters
35Prescribed activity
(1)The prescribed activity is—
(a)decommissioning one or more—
(i)gas‑fired hot water boilers or gas‑fired water heaters; or
(ii)electric resistance hot water boilers or electric resistance water heaters—
and having one or more products listed on the ESC register as belonging to a product category whose category number is specified in column 1 of Table 44.1 installed by a licensed or registered plumber; or
(b)having one or more products listed on the ESC register as belonging to a product category whose category number is specified in column 1 of Table 44.1 installed by a licensed or registered plumber.
(2)A product referred to in subregulation (1)(a) to be decommissioned must be—
(a)in working order; and
(b)excluding the insulated storage tank that forms part of the product, at least 10 years old at the date it is decommissioned.
(3)If a product referred to in subregulation (1)(a) to be decommissioned includes an insulated storage tank that is less than 10 years old at the date the product is decommissioned, the Secretary's specifications may provide that the storage tank may be used with the product to be installed.

(i) has an insulated storage volume not exceeding 700 litres; and
(ii) is certified by an accredited body as complying with AS/NZS 2712; and
(iii) provides a minimum delivery temperature of 45 degrees Celsius; and
(iv) achieves the specified minimum annual energy savings; and
(v) is modelled against the specified heat pump modelling requirements; or
(b) a product that—
(i) has an insulated storage volume exceeding 700 litres; and
(ii) provides a minimum delivery temperature of 45 degrees Celsius; and
(iii) achieves the specified minimum annual energy savings; and
(iv) is modelled against the specified heat pump modelling requirements.
44B An air source heat pump water heater that is either—
(a) a product that—
(i) has an insulated storage volume not exceeding 700 litres; and
(ii) is certified by an accredited body as complying with AS/NZS 2712; and
(iii) provides a minimum delivery temperature of 45 degrees Celsius; and
(iv) achieves the specified minimum annual energy savings; and
(v) is modelled against the specified heat pump modelling requirements; or
(b) a product that—
(i) has an insulated storage volume exceeding 700 litres; and
(ii) provides a minimum delivery temperature of 45 degrees Celsius; and
(iii) achieves the specified minimum annual energy savings; and
(iv) is modelled against the specified heat pump modelling requirements.
44C An air source heat pump water heater that is either—
(a) a product that—
(i) has an insulated storage volume not exceeding 700 litres; and
(ii) is certified by an accredited body as complying with AS/NZS 2712; and
(iii) provides a minimum delivery temperature of 45 degrees Celsius; and
(iv) achieves the specified minimum annual energy savings; and
(v) is modelled against the specified heat pump modelling requirements; or
(b) a product that—
(i) has an insulated storage volume exceeding 700 litres; and
(ii) provides a minimum delivery temperature of 45 degrees Celsius; and
(iii) achieves the specified minimum annual energy savings; and
(iv) is modelled against the specified heat pump modelling requirements.
44D A product that meets the requirements of the Secretary's specifications for this item.". 7Schedule 3—New clause 44 inserted
After clause 43 of Schedule 3 to the Principal Regulations insert—
"44 Air source heat pump water heaters—Schedule 2, Part 44
The time specified for the purposes of regulation 11(1) and (2) for a prescribed activity set out in Part 44 of Schedule 2 is the later of—
(a)the day on which the installation and commissioning of the product are complete; or
(b)the day on which the existing gas‑fired hot water boiler, gas‑fired water heater, electric resistance hot water boiler or electric resistance water heater is decommissioned.".
8Reference to Building Code substituted
(1)In regulation 5 of the Principal Regulations—
(a)in paragraph (h) of the definition of controlled heating or cooling product, for "A3" (wherever occurring) substitute "A6";
(b)in the definition of residential premises, for "A3" substitute "A6".
(2)In regulation 10 of the Principal Regulations, for "A3" (wherever occurring) substitute "A6".
(3)In clause 20(1) of Schedule 2 to the Principal Regulations, for "A3" (wherever occurring) substitute "A6".
