Alteration of other rules of organisation.

[1]        On 21 November 2014 the Victorian Employers' Chamber of Commerce and Industry

(the organisation) lodged with the Fair Work Commission (the Commission) a notice and

declaration setting out particulars of alterations to the rules of the organisation.

[2]        The particulars set out a series of alterations to the rules that act to alter the election

timetable of the organisation, introduce the Office of Past President, introduce a new financial

membership prerequisite before being eligible to hold office and allow the organisation to

make payments by electronic transfer amongst other things.

[3]        Following discussions with the staff of the Commission, the organisation determined

to undertake further alterations to the election timetable to provide for the rectification of

defective nominations and to the transitional provisions concerning the new prerequisites for

being nominated to office. On 27 April 2015, a further notice and declaration setting out

particulars of alterations to the rules of the organisation was received by the Commission.

[4]        On the information contained in the notices, I am satisfied the alterations have been

made under the rules of the organisation.

[5]        On 19 May 2015, the Commission received consent from Mark Stone, Secretary,

under subsection 159(2) of the Fair Work (Registered Organisations) Act 2009, for the

Delegate to make various amendments to the alterations for the purpose of correcting

typographical, clerical or formal errors. Accordingly the following corrections have been

made:

In rule 12(c) ‘officer bearer’ has been changed to ‘office bearer’;
In rule 17(a), the phrase ‘provisions for contained’ has had the word ‘for’ removed;
In rule 22(g), references to sub rules 22(g) and (h) have been renumbered to 22(h) and
(i);
In rule 22(i), a reference to sub rule 22(g) is renumbered to 22(h);

 In rule 22A(b), the phrase ‘The eight members (8) members’ has had the first

‘members’ removed;

In rule 22A(l) the phrase ‘Annual General Meeeting in the 2015’ has been corrected to
‘Annual General Meeting in 2015’;

 In rule 22A, a second sub rule 22A(j) has been renumbered to 22A(k), including an

internal reference; and

In rule 22A, sub rules 22A(k) and (l) have been renumbered 22A(l) and (m).

[6]        In my opinion, the alterations comply with and are not contrary to the Fair Work

(Registered Organisations) Act 2009, the Fair Work Act 2009, modern awards and enterprise

agreements, and are not otherwise contrary to law. I certify accordingly under subsection

159(1) of the Fair Work (Registered Organisations) Act 2009.
