Victorian Civil and Administrative Tribunal (Fees) Amendment Regulations 2021

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Victorian Civil and Administrative Tribunal (Fees) Regulations 2016—

(a)to prescribe fees payable for the commencement of a proceeding in the Victorian Civil and Administrative Tribunal under the following Acts and Regulations—

(i)the Gender Equality Act 2020;

(ii)the Professional Engineers Registration Act 2019;

(iii)the Retirement Villages (Contractual Arrangements) Regulations 2017;

(iv)the Sale of Land Act 1962;

(v)the Worker Screening Act 2020; and

(b)to update references to sections in the Sale of Land Act 1962 to reflect changes to the sections under which proceedings may be commenced under the Sale of Land Act 1962 in the Victorian Civil and Administrative Tribunal; and

(c)to remove the reference to the Working with Children Act 2005 consequential to the commencement of the Worker Screening Act 2020.

2Authorising provision

These Regulations are made under section 161 of the Victorian Civil and Administrative Tribunal Act 1998.

3Commencement

These Regulations come into operation on 31 March 2021.

4Principal Regulations

In these Regulations, the Victorian Civil and Administrative Tribunal (Fees) Regulations 2016[1] are called the Principal Regulations.

5Schedule 1—Fees

(1)In item 1 of Schedule 1 to the Principal Regulations, before "Guardianship and Administration Act 1986" insert—

"Gender Equality Act 2020".

(2)In item 3 of Schedule 1 to the Principal Regulations, after "Retirement Villages Act 1986" insert—

"Retirement Villages (Contractual Arrangements) Regulations 2017".

(3)In item 3 of Schedule 1 to the Principal Regulations, for "Sale of Land Act 1962, section 44" substitute—

"Sale of Land Act 1962".

(4)In item 4 of Schedule 1 to the Principal Regulations, after "Professional Boxing and Combat Sports Act 1985" insert—

"Professional Engineers Registration Act 2019".

(5)In item 4 of Schedule 1 to the Principal Regulations, for "Working with Children Act 2005" substitute—

"Worker Screening Act 2020".
