Victorian Civil and Administrative Tribunal (Fees) Amendment Regulations 2019

The Lieutenant-Governor as the Governor's deputy, with the advice of the Executive Council, makes the following Regulations:

1Objectives

The objectives of these Regulations are to amend the Victorian Civil and Administrative Tribunal (Fees) Regulations 2016 to—

(a)prescribe fees payable for the commencement of a proceeding in the Victorian Civil and Administrative Tribunal under the following Acts—

(i)the Business Licensing Authority Act 1998;

(ii)the Commercial Passenger Vehicle Industry Act 2017;

(iii)the Labour Hire Licensing Act 2018;

(iv)the Long Service Benefits Portability Act 2018;

(v)the Service Victoria Act 2018; and

(b)prescribe that no fee is payable for the commencement of a proceeding in the Victorian Civil and Administrative Tribunal under—

(i)Part 12A of the Residential Tenancies Act 1997; and

(ii)the Voluntary Assisted Dying Act 2017; and

(c)update a reference to the Major Sporting Events Act 2009 consequential to the commencement of the Major Events Legislation Amendment (Ticket Scalping and Other Matters) Act 2018; and

(d)update a reference to a particular section of the Small Business Commissioner Act 2003 consequential to the commencement of the Small Business Commissioner Act 2017; and

(e)update references to particular sections of the Building Act 1993 consequential to the commencement of the Building Legislation Amendment (Consumer Protection) Act 2016.

2Authorising provision

These Regulations are made under section 161 of the Victorian Civil and Administrative Tribunal Act 1998.

3Principal Regulations

In these Regulations, the Victorian Civil and Administrative Tribunal (Fees) Regulations 2016[1] are called the Principal Regulations.

4Schedule 1 amended

(1)In item 1 of Schedule 1 to the Principal Regulations, after "Residential Tenancies Act 1997, Part 10" insert

"and Part 12A".

(2)In item 1 of Schedule 1 to the Principal Regulations, after "Supported Residential Services (Private Proprietors) Act 2010, sections 105 and 121." insert

"Voluntary Assisted Dying Act 2017".

(3)In item 2 of Schedule 1 to the Principal Regulations, after "Residential Tenancies Act 1997, except Part 10" insert

"and Part 12A".

(4)In item 3 of Schedule 1 to the Principal Regulations, for "Building Act 1993, except sections 25J and 182A" substitute

"Building Act 1993, except sections 25J and 186".

(5)In item 4 of Schedule 1 to the Principal Regulations, for "Building Act 1993,
sections 25J and 182A" substitute

"Building Act 1993, sections 25J and 186".

(6)In item 4 of Schedule 1 to the Principal Regulations, after "Bus Safety Act 2009" insert

"Business Licensing Authority Act 1998".

(7)In item 4 of Schedule 1 to the Principal Regulations, after "Children's Services Act 1996" insert

"Commercial Passenger Vehicle Industry Act 2017".

(8)In item 4 of Schedule 1 to the Principal Regulations, after "Health Services
Act 1988
, sections 57C and 110" insert

"Labour Hire Licensing Act 2018".

(9)In item 4 of Schedule 1 to the Principal Regulations, after "Local Government
