(Amendment) Regulations 2002

The Governor in Council makes the following Regulations:

1. Objective

The objective of these Regulations is to make miscellaneous amendments to the Victorian Civil and Administrative Tribunal (Fees) Regulations 2001.

2. Authorising provisions

These Regulations are made under section 161 of
the Victorian Civil and Administrative

Tribunal Act 1998.

3. Commencement

These Regulations come into operation on

1 February 2002.

4. Amendments to Scale of Fees

In regulation 4 of the Victorian Civil and in Part A of the Table—

Victorian Civil and Administrative Tribunal (Fees)
(Amendment) Regulations 2002

(a) after clause 1(f) insert—

"(fa) Instruments Act 1958;

(fb) Medical Treatment Act 1988;";

(b) in clause 1(g), for "sections 79, 86 and 120" substitute "section 79";

(c) after clause 2(2)(d) insert—

"(da) Landlord and Tenant Act 1958;";

(d) clause 4(zq) is revoked;

(e) clause 4(zzb) is revoked;

(f) for clause 4(zzp) substitute—

"(zzp) Planning and Environment Act 1987

(except sections 39(1), 79, 81(b), 87,
89, 93, 114, 120, 121, 123, 149, 149A,
149B and 184) if the development is
valued at less than $5 000 000 or
irrespective of the value of the
development if the proceeding is

commenced under section 82 or 82B;";

(g) clause 4(zzzp) is revoked;

(h) in clause 4(zzzx), after "1994" insert "(except section 74)";

(i) for clause 6(c) substitute—

"(c) Planning and Environment Act 1987 (except if the application is made under sections 39(1), 79, 81(b), 82, 82B, 87,

89, 93, 114, 120, 121, 123, 149, 149A,
149B or 184) if the development is

valued at $5 000 000 or more;".
