Victorian Civil and Administrative Tribunal Act 1998

Victorian Civil and Administrative Tribunal (Disability and Social Services Regulation Amendments) Rules 2024

The Rules Committee established by section 150 of the Victorian Civil and Administrative Tribunal Act 1998 makes the following Rules:

1Object

The object of these Rules is to make amendments to the Victorian Civil and Administrative Tribunal Rules 2018 in relation to SDA enrolled dwellings as a consequence of amendments made to the Residential Tenancies Act 1997 by the Disability and Social Services Regulation Amendment Act 2023.

2Authorising provision

These Rules are made under section 157 of the Victorian Civil and Administrative Tribunal Act 1998 and all other enabling powers.

3Commencement

These Rules come into operation on 1 July 2024.

4Principal Rules

In these Rules, the Victorian Civil and Administrative Tribunal Rules 2018[1] are called the Principal Rules.

5Documents required to be included with certain applications

(1)In Rule 8.07(2A) of the Principal Rules omit "enrolled".

(2)In Rule 8.07(5A) of the Principal Rules omit "enrolled".

(3)In Rule 8.07(8) of the Principal Rules omit "enrolled".

(4)In Rule 8.07(15A) of the Principal Rules omit "enrolled".

(5)Rule 8.07(15BA) and (15C) of the Principal Rules are revoked.

6Particulars to be provided with certain applications

(1)In Rule 8.08(1)(c) of the Principal Rules, for "Act; or" substitute "Act.".

(2)Rule 8.08(1)(d) of the Principal Rules is revoked.

(3)In Rule 8.08(4)(b) of the Principal Rules omit "enrolled".

(4)Rule 8.08(4B) of the Principal Rules is revoked.

7Warrant of possession—SDA enrolled dwelling

In the heading to Rule 8.12A of the Principal Rules omit "enrolled".

8Rule 8.13 revoked

Rule 8.13 of the Principal Rules is revoked.

9Residential Tenancies List

In clause 9(1) of Schedule 1 to the Principal Rules, item 9.2 is revoked.

10Forms in Schedule 2 amended

(1)Form 6 of Schedule 2 to the Principal Rules is revoked.

(2)In the heading to Form 7 of Schedule 2 to the Principal Rules omit "enrolled".

(3)In Form 7 of Schedule 2 to the Principal Rules—

(a)omit "ENROLLED";

(b)omit "enrolled" (wherever occurring).
