Victorian Civil and Administrative Tribunal Act 1998

Victorian Civil and Administrative Tribunal (Amendment No. 18) Rules 2007

The Rules Committee established by section 150 of the Victorian Civil and Administrative Tribunal Act 1998 makes the following Rules:

1Object

The object of these Rules is to allocate some enactments and provisions of enactments to some of the lists of the Tribunal.

2Authorising provisions

These Rules are made under section 157 of the Victorian Civil and Administrative Tribunal Act 1998 and all other enabling powers.

3Commencement

These Rules come into operation on 1 July 2007.

4Amendment to Schedule 1—Allocation of functions

(1)In Schedule 1 to the Victorian Civil and Administrative Tribunal Rules 1998[1], in Part 1—

(a)in item 1, after paragraph (g) insert—

"(ga)Disability Act 2006 section 50 (decision as to disability);";

(b)in item 3, after paragraph (ha) insert—

"(hab)Disability Act 2006 section 45 (registration of a disability service provider);";

(c)in item 3, for paragraph (ob) substitute—

"(ob)Health Professions Registration Act 2005 Part 4;";

(d)in item 3, after paragraph (z) insert—

"(zaaa)Owner Drivers and Forestry Contractors Act 2005 section 41 (dispute between contractor and hirer);";

(e)in item 3, after paragraph (zf) insert—

"(zfa)Surveying Act 2004 section 33 (review of decision, finding or determination);";

(f)in item 4, after "the administrative division—" insert—

"(aa)Aboriginal Heritage Act 2006;".

(2)In Schedule 1 to the Victorian Civil and Administrative Tribunal Rules 1998, in Part 2, in item 7, after "the civil division—" insert—

"(aa)Disability Act 2006 Part 5 Divisions 2 and 3;" .

(3)In Schedule 1 to the Victorian Civil and Administrative Tribunal Rules 1998, in Part 3, in item 2, after "the human rights division—" insert—

"(aa)Disability Act 2006 Part 7, Part 8 Divisions 1, 3 and 5;".
