Victorian Civil and Administrative Tribunal Act 1998

Victorian Civil and Administrative Tribunal (Amendment No. 15) Rules 2016

The Rules Committee established by section 150 of the Victorian Civil and Administrative Tribunal Act 1998 makes the following Rules:

1Object

The object of these Rules is to amend the Victorian Civil and Administrative Tribunal Rules 2008 to provide for—

(a)the delegation of certain certification powers of the principal registrar to other staff of the Tribunal; and

(b)certain exemptions in relation to proceedings in the Residential Tenancies List.

2Authorising provisions

These Rules are made under section 157 of the Victorian Civil and Administrative Tribunal Act 1998 and all other enabling powers.

3Commencement

These Rules come into operation on 5 September 2016.

4Application of Part 1 of Order 7A

In Rule 7A.02(2) of the Victorian Civil and Administrative Tribunal Rules 2008[1], for "and 4.08" substitute ", 4.08, 4.19(3) and 4.19(4)".

5Delegation of functions by principal registrar under section 32A of the Act

At the end of Rule 9.02 of the Victorian Civil and Administrative Tribunal Rules 2008 insert—

"(2)For the purposes of section 32A of the Act, the principal registrar may delegate the following functions of the principal registrar to a registrar, a deputy registrar or a regional administrative officer of the Tribunal—

(a)the certification of a copy of a monetary order as a true copy under section 121(1)(a) of the

Act;

(b)the certification of a copy of a non‑monetary order as a true copy under section 122(1)(a) of the Act.".
