The Parliament of Victoria enacts as follows:
1. Purposes
The purposes of this Act are—
(a)
to amend the Victorian Arts Centre Act 1979 to change the functions and powers of the Victorian Arts Centre Trust to enable the Trust to establish and manage a public collection of art; and

(b)
to amend the Museums Act 1983 to remove the requirement of Ministerial approval for the engagement of consultants and technical advisors by the Museums Board of Victoria.
2. Commencement
This Act comes into operation on the day after the day on which it receives the Royal Assent.
3. Principal Act

4. Public art collection
In Part 1 of the Principal Act, after section 3A
insert—"3B. Public art collection
The public art collection comprises all
artworks, including paintings, works on
paper, sculptures and textiles, of cultural,social or historical significance that are—
(a) vested in the Trust and accepted for the public art collection by the Trust; or (b) acquired and accepted for the public art collection by the Trust; or (c) given or bequeathed to the Trust or held on trust by the Trust, whether before or after the commencement of the Victorian Arts Centre (Amendment) Act 2001, by deed, will or otherwise to

Act No. 66/2001 s. 5 or in favour of the Trust or for the uses
or purposes of the Trust, and accepted
for the public art collection by the
Trust.".
5. Functions of the Trust
In section 5(1) of the Principal Act, after
paragraph (f) insert—"(fa) to establish, maintain, conserve, develop,
promote and exhibit the public art collection;
and
(fb) to make any object from the public art
collection available for study or loan to
persons or institutions, subject to anyconditions that the Trust determines; and".
6. Powers of the Trust
In section 6(2) of the Principal Act, after
paragraph (l), insert—"(la) to establish and operate a public art gallery;".
7. Disposal of works in public art collection
In section 18 of the Principal Act—
(a) in sub-section (1), after "State collection" insert "or the public art collection"; (b) in sub-section (2)(b), after "State collection" insert "or the public art collection, as the case may be,"; (c) in sub-section (7), after "State collection" insert "or the public art collection, as the case may be". 8.
