Victoria Police (Fees and Charges) Regulations 2024

1Objective

The objective of these Regulations is to prescribe—

(a)fees and amounts payable for the purposes of Part 14A of the Victoria Police Act 2013; and

(b)charges for services provided by police officers, protective services officers and Victoria Police employees; and

(c)fees for applications by media organisations for authorisation to be given agency photographs; and

(d)fees for applications by authorised media organisations for the giving of agency photographs.

2Authorising provision

These Regulations are made under section 277 of the Victoria Police Act 2013.

3Revocation

The Victoria Police (Fees and Charges) Regulations 2014[1] are revoked.

4Definition

In these Regulations—

the Act means the Victoria Police Act 2013.

5Fees for provision of police services and goods in connection with commercial events—before 1 January 2025

(1)For the purposes of section 274B of the Act, before 1 January 2025 the fees specified in subregulation (2) may be imposed by the Chief Commissioner in connection with a commercial event for the provision of services, being services of a person of a rank or class specified in Column 1 of the Table in Schedule 1—

(a)to the place at which the commercial event is taking place; and

(b)in any area surrounding the commercial event for the purposes of traffic management, including—

(i)managing traffic arriving at and leaving the event; and

(ii)isolating people and traffic participating in the event from people and traffic not participating in the event.

(2)For the purposes of subregulation (1), the specified fees are the following—

(a)for the first hour or part of an hour of those services, the corresponding amount specified in Column 2 of the Table in Schedule 1;

(b)for each half hour or part of a half hour after the first hour, the corresponding amount specified in Column 3 of the Table in Schedule 1.

(3)For the purposes of subregulation (2), in determining the period of time for which a person's services are provided, the Chief Commissioner must include only the period of time—

(a)beginning when the person commences duty at the event; and

(b)ending when the person is dismissed from duty at the event.

(4)For the purposes of section 274B of the Act, before 1 January 2025 the fees specified in subregulation (5) may be imposed by the Chief Commissioner in connection with a commercial event for the provision of services, being services specified in Column 1 of the Table in Schedule 3, to the place at which the commercial event is taking place.

(5)For the purposes of subregulation (4), the specified fees are the following—

(a)for the first hour or part of an hour of those services, the corresponding amount specified in Column 2 of the Table in Schedule 3;

(b)for each half hour or part of a half hour after the first hour, the corresponding amount specified in Column 3 of the Table in Schedule 3.

(6)For the purposes of subregulation (5), in determining the period of time for which services are provided, the Chief Commissioner must include only the period of time—

(a)beginning when the services are brought into operation for the event; and

(b)ending when the services are no longer required for the event.

(7)For the purposes of section 274B of the Act, before 1 January 2025 the fees that may be imposed by the Chief Commissioner in connection with a commercial event for the provision of police services and goods that are not ordinarily available within Victoria Police are the amounts that represent the costs incurred by the Chief Commissioner in acquiring those services and goods.

6Fees for provision of police services and goods in connection with commercial events—on or after 1 January 2025

(1)For the purposes of section 274B of the Act, on or after 1 January 2025 the fees specified in subregulation (2) may be imposed by the Chief Commissioner in connection with a commercial event for the provision of services, being services of a person of a rank or class specified in Column 1 of the Table in Schedule 2—

(a)to the place at which the commercial event is taking place; and

(b)in any area surrounding the commercial event for the purposes of traffic management or the performance of any of the functions of Victoria Police.

(2)For the purposes of subregulation (1), the specified fees are the following—

(a)for the first hour or part of an hour of those services, the corresponding amount specified in Column 2 of the Table in Schedule 2;

(b)for each half hour or part of a half hour after the first hour, the corresponding amount specified in Column 3 of the Table in Schedule 2.

(3)For the purposes of subregulation (2), in determining the period of time for which a person's services are provided, the Chief Commissioner—

(a)must include the period of time—

(i)beginning when the person commences duty at the event; and

(ii)ending when the person is dismissed from duty at the event; and

(b)may include the period of time spent by the person in planning for the provision of their services.

(4)For the purposes of section 274B of the Act, on or after 1 January 2025 the fees specified in subregulation (5) may be imposed by the Chief Commissioner in connection with a commercial event for the provision of services, being services specified in Column 1 of the Table in Schedule 4—

(a)to the place at which the commercial event is taking place; and

(b)in any area surrounding the commercial event for the purposes of traffic management or the performance of any of the functions of Victoria Police.

(5)For the purposes of subregulation (4), the specified fees are the following—

(a)for the first hour or part of an hour of those services, the corresponding amount specified in Column 2 of the Table in Schedule 4;

(b)for each half hour or part of a half hour after the first hour, the corresponding amount specified in Column 3 of the Table in Schedule 4.

(6)For the purposes of subregulation (5), in determining the period of time for which services are provided, the Chief Commissioner—

(a)must include the period of time—

(i)beginning when the services are brought into operation for the event; and

(ii)ending when the services are no longer required for the event; and

(b)may include the period of time spent by each member of Victoria Police personnel in planning for the provision of the services.

7Contracts and other arrangements for police services and goods

(1)For the purposes of section 274C of the Act, the amounts payable for the provision of services of a person of a rank or class specified in Column 1 of the Table in Schedule 2, in the absence of any agreement between the Chief Commissioner and the person operating the commercial enterprise, are the following—

(a)for the first hour or part of an hour of those services, the corresponding amount specified in Column 2 of that Table;

(b)for each half hour or part of a half hour after the first hour, the corresponding amount specified in Column 3 of that Table.

(2)For the purposes of subregulation (1), in determining the period of time for which a person's services are provided, the Chief Commissioner may include the period of time spent by the person in planning for the provision of their services.

(3)For the purposes of section 274C of the Act, the amounts payable for the provision of services specified in Column 1 of the Table in Schedule 4, in the absence of any agreement between the Chief Commissioner and the person operating the commercial enterprise, are the following—

(a)for the first hour or part of an hour of those services, the corresponding amount specified in Column 2 of that Table;

(b)for each half hour or part of a half hour after the first hour, the corresponding amount specified in Column 3 of that Table.

(4)For the purposes of subregulation (3), in determining the period of time for which services are provided, the Chief Commissioner may include the period of time spent by each member of Victoria Police personnel in planning for the provision of the services.

(5)For the purposes of section 274C of the Act, the amounts payable for the provision of police services and goods that are not ordinarily available within Victoria Police, in the absence of any agreement between the Chief Commissioner and the person operating the commercial enterprise, are the amounts that represent the costs incurred by the Chief Commissioner in acquiring those services and goods.

8Charges for police information services—personnel time

(1)Subject to subregulation (4), the Chief Commissioner may impose charges for the provision of services by police officers, protective services officers or Victoria Police employees—

(a)who provide information or services—

(i)as a defence witness in a criminal proceeding; or

(ii)as a witness for any other party in a civil proceeding; or

(b)who are required to search police files and to provide information from those files; or

(c)who are required to supervise the examination of police files; or

(d)who provide information or services, including a search of files, in an interview by a member of the public about an incident reported to Victoria Police; or

(e)who are required to provide a sworn affidavit.

(2)For the purposes of subregulation (1), the charges for services by police officers, protective services officers or Victoria Police employees of a rank or class specified in Column 1 of the Table in Schedule 2 are the following—

(a)for the first hour or part of an hour of those services, the corresponding amount specified in Column 2 of that Table;

(b)for each half hour or part of a half hour after the first hour, the corresponding amount specified in Column 3 of that Table.

(3)For the purposes of subregulation (2), in determining the period of time for services to provide documents or other information, the Chief Commissioner must include the period of time required to search for, extract and review the documents or other information.

(4)If the Chief Commissioner imposes charges for the provision of services under regulation 9, the Chief Commissioner must not impose charges under this regulation in respect of the same services.

9Charges for police information services—fixed amount

(1)Subject to subregulation (2), the Chief Commissioner may impose charges for the provision of services by police officers, protective services officers or Victoria Police employees that are services specified in Column 1 of the Table in Schedule 5 in accordance with the corresponding amount specified in Column 2 of that Table.

(2)If the Chief Commissioner imposes charges for the provision of services under regulation 8, the Chief Commissioner must not impose charges under this regulation in respect of the same services.

10Fee for application for authorisation to be given agency photographs

For the purposes of section 237(2) of the Act, the prescribed fee is 11×6 fee units.

11Fee for application for giving of agency photographs

For the purposes of section 239(2)(a) of the Act, the prescribed fee is 33×7 fee units.

The Victoria Police (Fees and Charges) Regulations 2024, S.R. No. 50/2024 were made on 18 June 2024 by the Governor in Council under section 277 of the Victoria Police Act 2013, No. 81/2013 and came into operation on 18 June 2024.

The Victoria Police (Fees and Charges) Regulations 2024 will sunset 10 years after the day of making on 18 June 2034 (see section 5 of the Subordinate Legislation Act 1994).

INTERPRETATION OF LEGISLATION ACT 1984 (ILA)

Style changes

Section 54A of the ILA authorises the making of the style changes set out in Schedule 1 to that Act.

References to ILA s. 39B

Sidenotes which cite ILA s. 39B refer to section 39B of the ILA which provides that where an undivided regulation, rule or clause of a Schedule is amended by the insertion of one or more subregulations, subrules or subclauses the original regulation, rule or clause becomes subregulation, subrule or subclause (1) and is amended by the insertion of the expression "(1)" at the beginning of the original regulation, rule or clause.

Interpretation

As from 1 January 2001, amendments to section 36 of the ILA have the following effects:

•     Headings

All headings included in a Statutory Rule which is made on or after
1 January 2001 form part of that Statutory Rule.  Any heading inserted in a Statutory Rule which was made before 1 January 2001, by a Statutory Rule made on or after 1 January 2001, forms part of that Statutory Rule.
This includes headings to Parts, Divisions or Subdivisions in a Schedule; Orders; Parts into which an Order is divided; clauses; regulations; rules; items; tables; columns; examples; diagrams; notes or forms. 
See section 36(1A)(2A)(2B).

•     Examples, diagrams or notes

All examples, diagrams or notes included in a Statutory Rule which is made on or after 1 January 2001 form part of that Statutory Rule.  Any examples, diagrams or notes inserted in a Statutory Rule which was made before 1 January 2001, by a Statutory Rule made on or after 1 January 2001, form part of that Statutory Rule.  See section 36(3A).

•     Punctuation

All punctuation included in a Statutory Rule which is made on or after
1 January 2001 forms part of that Statutory Rule.  Any punctuation inserted in a Statutory Rule which was made before 1 January 2001, by a Statutory Rule made on or after 1 January 2001, forms part of that Statutory Rule.

•     Provision numbers

All provision numbers included in a Statutory Rule form part of that Statutory Rule, whether inserted in the Statutory Rule before, on or after
1 January 2001.  Provision numbers include regulation numbers, rule numbers, subregulation numbers, subrule numbers, paragraphs and subparagraphs.  See section 36(3C).

•     Location of "legislative items"

A "legislative item" is a penalty, an example or a note.  As from 13 October 2004, a legislative item relating to a provision of a Statutory Rule is taken to be at the foot of that provision even if it is preceded or followed by another legislative item that relates to that provision.  For example, if a penalty at the foot of a provision is followed by a note, both of these legislative items will be regarded as being at the foot of that provision.  See section 36B.

•     Other material

Any explanatory memorandum, table of provisions, endnotes, index and other material printed after the Endnotes does not form part of a Statutory Rule.  See section 36(3)(3D)(3E).

2   Table of Amendments

There are no amendments made to the Victoria Police (Fees and Charges) Regulations 2024 by statutory rules, subordinate instruments and Acts.

Fee Units

These Regulations provide for fees by reference to fee units within the meaning of the Monetary Units Act 2004.

The amount of the fee is to be calculated, in accordance with section 7 of that Act, by multiplying the number of fee units applicable by the value of a fee unit.

The value of a fee unit for the financial year commencing 1 July 2023 is $15.90 and for the financial year commencing 1 July 2024 is $16.33. The amount of the calculated fee may be rounded to the nearest 10 cents.

The value of a fee unit for future financial years is to be fixed by the Treasurer under section 5 of the Monetary Units Act 2004. The value of a fee unit for a financial year must be published in the Government Gazette and a Victorian newspaper before 1 June in the preceding financial year.
