The Parliament of Victoria enacts:

1Purpose

The purpose of this Act is to amend Victorian Acts as a consequence of the enactment of the Victoria Police Act 2013 and to amend that Act.

2Commencement

(1)Subject to subsection (2), this Act comes into operation on a day or days to be proclaimed.

(2)If a provision of this Act other than section 10(2) or (3) or item 95, 141, 142 or 143 of the Schedule does not come into operation before 1 January 2015, it comes into operation on that day.

3Principal Act

In this Act the Victoria Police Act 2013 is called the Principal Act.

4Appointment of former police officers

In section 30(3) of the Principal Act—

(a)in paragraph (b), for "rank; and" substitute "rank.";

(b)paragraph (c) is repealed.

5New section 124A inserted

After section 124 of the Principal Act insert

"124A   Publication of statements of reasons

(1)The PRS Board may publish a statement of reasons for its decision to refuse an application for registration under Division 1 or an application for renewal of registration under Division 2 only if the PRS Board is satisfied that publishing the statement is in the public interest.

(2)The PRS Board must publish a statement of reasons for its decision to cancel registration under Division 3 unless the PRS Board is satisfied that the publication of the statement would not be in the public interest.

(3)The PRS Board may exclude information from a statement of reasons published under subsection (1) or (2) if the PRS Board considers the exclusion to be in the public interest.".

6New section 154A inserted

After section 154 of the Principal Act insert

"154A   Obligation to publish statements of reasons for decisions on review

(1)The PRS Board must publish a statement of reasons for its decision on a review unless the PRS Board is satisfied that the publication of the statement would not be in the public interest.

(2)The PRS Board may exclude information from a statement of reasons published under subsection (1) if the PRS Board considers the exclusion to be in the public interest.".

7New section 165A inserted

After section 165 of the Principal Act insert

"165A   Obligation to notify parties to an appeal or a review of decision

The PRS Board must notify each party of its decision on an appeal or a review within 14 days after the decision is made.".

8Amendments to Schedule 5

In Schedule 5 to the Principal Act, after clause 4.2 insert

"4.3Appeals and reviews under Part 8.".

9Amendments to Schedule 6

(1)In the heading to clause 6 of Schedule 6 to the Principal Act omit "to the force and members of the force".

(2)After clause 6(2) of Schedule 6 to the Principal Act insert

"(3)A reference in any Act (other than this Act), subordinate instrument, agreement, deed or other document to a protective services officer under, or appointed under, the Police Regulation Act 1958 must be construed as a reference to a protective services officer within the meaning of this Act—

(a)so far as the reference relates to any period on or after the commencement day; and

(b)if not inconsistent with the subject matter.

(4)A reference in any Act (other than this Act), subordinate instrument, agreement, deed or other document to a police recruit under, or appointed under, the Police Regulation Act 1958 must be construed as a reference to a police recruit within the meaning of this Act—

(a)so far as the reference relates to any period on or after the commencement day; and

(b)if not inconsistent with the subject matter.

(5)A reference in any Act (other than this Act), subordinate instrument, agreement, deed or other document to an executive, a police employee, a person employed by Victoria Police, or a person employed in the Office of the Chief Commissioner must be construed as a reference to a Victoria Police employee—

(a)so far as the reference relates to any period on or after the commencement day; and

(b)if not inconsistent with the subject matter.

(6)A reference in any Act (other than this Act), subordinate instrument, agreement, deed or other document to a special constable under, or appointed under, the Police Regulation Act 1958 must be construed as a reference to a special constable within the meaning of this Act—

(a)so far as the reference relates to any period on or after the commencement day; and

(b)if not inconsistent with the subject matter.".

10Consequential amendments

(1)On the coming into operation of an item in the Schedule, the Act specified in the heading to that item is amended as set out in the item.

(2)If section 103 of the Transport Legislation Amendment (Rail Safety Local Operations and Other Matters) Act 2013 comes into operation before the day on which item 141 of the Schedule comes into operation, then item 141 of the Schedule is repealed on the day on which that section comes into operation.

(3)If section 103 of the Transport Legislation Amendment (Rail Safety Local Operations and Other Matters) Act 2013 is not in operation on the day on which item 141 of the Schedule comes into operation, then items 142.1 and 142.3 of the Schedule are repealed on the day on which item 141 of the Schedule comes into operation.

11Statute law revision

(1)In section 235(2)(a)(ii) of the Principal Act, for "a another" substitute "another".

(2)In section 277 of the Principal Act—

(a)in subsection (1), after "necessary to be" insert "prescribed";

(b)in subsection (2)(e), for "things any" substitute "things from any".

12Repeal of amending Act

This Act is repealed on the first anniversary of the first day on which all of its provisions are in operation.

Note

The repeal of this Act does not affect the continuing operation of the amendments made by it (see section 15(1) of the Interpretation of Legislation Act 1984).
