Veterinary Surgeons (Artificial Breeding o f Stock) Amendment 1985

BE it enacted by the Queen’s Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows:

Short title

1. This Act may be cited as the ‘Veterinary Surgeons (Artificial Breeding

of Stock) Amendment Act 1985” .

Commencement

2.       ( 1) Except as provided by subsections (2) and (3), this Act shall

commence on the date of assent to this Act.

(2) Schedule 1(1), and section 3 in its application to that provision, shall commence on the day appointed and notified under section 2 (2) of the Stock (Artificial Breeding) Act 1985 for the commencement of section 15 of that Act.

(3) Schedule 1 (2), and section 3 in its application to that provision, shall commence on the day appointed and notified under section 2 (2) of the Stock (Artificial Breeding) Act 1985 for the commencement of section 9 of that Act.

Amendment of Act No. 25, 1923

3. The Veterinary Surgeons Act 1923 is amended in the manner set forth

in Schedule 1.

SCHEDULE 1

(Sec. 3) AMENDMENTS TO THE VETERINARY SURGEONS ACT 1923 (1) Section 24 (fl)—

After section 24 (f), insert:

(fl) carry out any artificial breeding procedure, within the meaning of the Stock (Artificial Breeding) Act 1985, if the person is authorised so to do by a certificate of competency issued under that Act;

(2) Section 24b—

After the matter ‘section 24h.”, insert:

In subsection (1) , “veterinary hospital” does not include a place at which an artificial breeding procedure, within the meaning of the Stock (Artificial Breeding) Act 1985, is carried out if—

( 1 a )

(a)	the use of the place for the carrying out of that procedure is authorised by a licence in force under that Act; and
(b)	no other act, matter or thing the doing or performance of which forms part of the practice of veterinary science is done or performed at the place.
