Veterinary Surgeons Amendment

Regulation 1996

Veterinary Surgeons Act 1986

His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Veterinary Surgeons Act 1986.

Explanatory note

At present a person who is not a registered veterinary surgeon may diagnose pregnancy in cattle only if the person is the owner of the cattle. (See section 37 (4) of the Veterinary Surgeons Act 1986). This prevents such persons from being taught to diagnose pregnancy on cattle owned by other persons. The object of this Regulation is to allow unregistered persons to diagnose pregnancy on such cattle if they do so while undertaking an approved training course in pregnancy diagnosis.

This Regulation is made under the Veterinary Surgeons Act 1986, including section 44 (l) (m) and section 71 (the general regulation making power).

1 Name of Regulation

This Regulation is the veterinary Surgeons Amendment

Regulation 1996.

2 commencement

This Regulation commences on I January 1997.

3 Amendment of Veterinary Surgeons Regulation 1995

The Veterinary Surgeons Regulation 1995 is amended as set out

in Schedule l .

Insert after Part 4:

Part 4A Permitted practices for unregistered
persons

29A Person who undertakes training may carry out

pregnancy testing on cattle not owned by the person

(1) A person, other than a veterinary surgeon, who undertakes an approved training course may, as part of the training course, diagnose pregnancy in cattle he or she does not own.
(2) In this clause:
approved training course means a course approved by a
committee that is conducted by:
(a) a veterinary surgeon who is the holder of an animal research licence within the meaning of the Animal Research Act 1985, or
(b) a veterinary surgeon who is the holder of an animal research authority within the meaning of the Animal Research Act 1985, or
(c) a veterinary surgeon for an accredited research establishment within the meaning of the Animal Research Act 1985 that has been approved by a committee.
committee means an Animal Care and Ethics Committee
as constituted under the Animal Research Act 1985.
