VETERINARY PREPARATIONS AND ANIMAL FEEDING STUFFS
AMENDMENT REGULATIONS (No. 2) 1991
Made by His Excellency the Governor in Executive Council.
Citation1. These regulations may be cited as the Veterinary Preparations and Animal
Feeding Stuffs Amendment Regulations (No. 2) 1991.
Commencement into operation.
2. These regulations shall come into operation on the day on which the

Principal regulations
Regulations* are referred to as the principal regulations. 3. In these regulations the Veterinary Preparations and Animal Feeding Stuffs [*published in the Government Gazette of 15 July 1977 at pp. 2270-77. For amendments to 22 July 1991 see p. 388 of 1990 Index to Legislation of Western

Regulation 2 amended
4. Regulation 2 of the principal regulations is amended by inserting after thedefinition of "Form" the following definition—
"pharmaceutical chemist" means a pharmaceutical chemist registered
under the Pharmacy Act 1964. ".
Regulation 5 amended
5. Regulation 5 of the principal regulations is amended by inserting" appli-cation " after "The".
Regulation 8 repealed and a regulation substituted
6. Regulation 8 of the principal regulations is repealed and the following
regulation is substituted-8. A representative member of the Advisory Committee is entitled to be paid $76 for each half day or part thereof attended by the representative member • at a meeting of the committee. ".
Regulation 9 amended
7. Regulation 9 of the principal regulations is amended—
(a) in subregulation (1) by deleting the following—
Register 3 Listing Veterinary Preparations the use of which is
restricted to Veterinary Surgeons only; "; and
(b)
by deleting subregulation (4) and substituting the following subregula- tion—
(4) A person who—
(a)
not being a Veterinary Surgeon or a pharmaceutical chemist, supplies by retail a Veterinary Preparation listed in Register 2;
(b)
being a pharmaceutical chemist, supplies by retail a Veterinary Preparation listed in Register 2, without having received a written prescription signed by a Veterinary Surgeon in respect of that sale; or
(c)
supplies by wholesale a Veterinary Preparation listed in Register 2 to a person not being a pharmaceutical chemist or a Veterinary Surgeon,
commits an offence. ".
Regulation 12 amended
8. Regulation 12 of the principal regulations is amended—
(a) by deleting paragraph (c) and substituting the following paragraph—
(c) identification and amount of active constituent; "; and
(b) by deleting paragraph (1) and substituting the following paragraph—
(1) the batch number of the preparation. ".
Regulation 16 amended
9. Regulation 16 of the principal regulations is amended in subregulations (1)and (2)—
(a) by deleting paragraph (b) in each subregulation; and
(b) after paragraph (d) in each subregulation by deleting—
(i) "preparation" and substituting the following—
product "; and
(ii) "stock" and substituting the following—
animals ".
Regulation 17 amended
10. Regulation 17 of the principal regulations is amended— (a) in subregulation (1)—
(i) by deleting "bovine"; and
(ii) by deleting "specified in Schedule Four of the Poisons Act, 1964"; and

(b)
in subregulation (3) by deleting "40290" and substituting the follow- ing—
" 42090 ".
Regulations 18 and 18B repealed
11. Regulations 18 and 18B of the principal regulations are repealed.
Regulation 19 repealed and a regulation substituted
12. Regulation 19 of the principal regulations is repealed and the following
regulation is substituted-19. (1) A warning statement shall be included on any label for a mineral mixture, a block or a lick containing copper (Cu) in excess of 10 parts per million for sheep.
(2) The warning statement referred to in subregulation (1) shall state
that the product—
(a) should not be used where the sheep are already copper sufficient; or
(b) should be used with care, where the sheep have been grazing in pastures containing plants which cause liver damage. ".
Transitional
13. (1) Regulation 12 of the principal regulations as amended by these
regulations does not apply to Veterinary Preparations which before the
commencement were labelled in accordance with regulation 12 of the principal
regulations.Regulation 19 of the principal regulations as substituted by these regulations does not apply to a mineral mixture which before the commence- ment carried a warning statement which complied with regulation 19 oil the principal regulations.
(2)
(3) For the purposes of subregulations (1) and (2), "commencement" means the commencement of these regulations.
