VETERINARY PREPARATIONS AND ANIMAL FEEDING STUFFS

AMENDMENT REGULATIONS 1995 Made by His Excellency the Governor in Executive Council. Citation

1.     These regulations may be cited as the Veterinary Preparations and

Animal Feeding Stuffs Amendment Regulations 1995.
Principal regulations

2.     In these regulations the Veterinary Preparations and Animal Feeding

Stuffs Regulations* are referred to as the principal regulations.

Commencement

3.     These regulations come into operation on the day Division 1 of Part 11 of

the Agricultural and Veterinary Chemicals (Western Australia) Act 1995

comes into operation.

Regulation 2 amended

4.     Regulation 2 of the principal regulations is amended in the definition of

"expiry date" by deleting "Veterinary Preparation or".
Regulation 3 repealed and a regulation substituted

5.     Regulation 3 of the principal regulations is repealed and the following

regulation is substituted -

Application for registration, or amendment of registration, of animal feeding stuff

3. An application for the registration or an amendment of the registration of an animal feeding stu* shall be in the form of Form 2 and shall be lodged with the Registrar together with the fee prescribed in regulation 5 (a) or (b), as the case requires.

Regulation 3A amended

6.     Regulation 3A of the principal regulations is amended

(a)	by deleting "a Veterinary Preparation or"; and
(b)	by deleting "regulation 5" and substituting the following -

regulation 5 (c) ".

Regulation 5 repealed and a regulation substituted

7.     Regulation 5 of the principal regulations is repealed and the following

regulation is substituted -

Application fees

5.    The application fee -

(a)	for the registration of an animal feeding stuff for a 3 year period is $83.00;
(b)	for an amendment of the registration of an animal feeding stuff is $53.00; and
(c)	for the renewal of registration of an animal feeding stuff for a 3 year period is $25.00.

Regulation 5A amended

8. Regulation 5A of the principal regulations is amended by repealing

subregulation (1) and substituting the following subregulation -

(1) An application for the issue of a temporary permit under

section 30 (4) of the Act in respect of an animal feeding stuff shall
be in the form of Form 2 and shall be lodged with the Registrar.

Regulation 6 amended

9.     Regulation 6 of the principal regulations is amended by deleting

"Veterinary Preparation or".
Regulation 9 amended

10.     Regulation 9 of the principal regulations is amended -

(a) in subregulation (1), by deleting the following -

a

Register 1. Listing Veterinary Preparations available

for sale without prescription;

Register 2. Listing Veterinary Preparations to be prescribed by Veterinary Surgeons and supplied by Veterinary Surgeons and Pharmaceutical Chemists only;

and

(b) by repealing subregulations (2), (3) and (4).

Regulation 10 amended

11.     Regulation 10 of the principal regulations is amended -

(a)	in subregulation (1), by deleting "published by the Technical Committee on Veterinary Drugs, Australian Department of Agriculture as amended to August, 1975 or where not so published as are"; and
(b)	by repealing subregulation (2) and substituting the following subregulation -

(2) The withholding periods that apply to ingredients of animal feeding stuffs are as approved by the Director.

Regulations 12,13 and 14 repealed

12. Regulations 12, 13 and 14 of the principal regulations are repealed.

Regulation 15 amended

13.     Regulation 15 of the principal regulations is amended by deleting

paragraph (j).

Regulation 16 amended

14.    Regulation 16 of the principal regulations is amended by deleting "a

product in both places where it occurs and substituting in each case the

following -

an animal feeding stuff

Regulations 16A, 17, 18A and 19 repealed

15.     Regulations 16A, 17, 18A and 19 of the principal regulations are

repealed.

Form No. 1 deleted

16.     Form No. 1 of the principal regulations is deleted.

Form No. 3 amended

17.    Form No. 3 of the principal regulations is amended by deleting

"Veterinary Preparations or" and substituting the following —
“ Animal 11.

Form No. 7 amended

18.    Form No. 7 of the principal regulations is amended by deleting

"VETERINARY PREPARATIONS AND".
