  1. Name

This instrument is the Veterans' Entitlements (Veterans’ Children Education Scheme -  Long Tan Bursary) Determination 2018.

  1. Commencement

This instrument commences immediately after the commencement of Schedule 4 to the Veterans’ Affairs Legislation Amendment (Veteran-centric Reforms No. 2) Act 2018.

Note: Schedule 4 to the Veterans’ Affairs Legislation Amendment (Veteran-centric Reforms No. 2) Act 2018 commences on 1 July 2019.

  1. Authority

This instrument is made under subsection 116CA(1) of the Act.

  1. Definitions

In this instrument:

Act means the Veterans’ Entitlements Act 1986.

eligible grandchild of a Vietnam veteran – see subsection 116(1) of the Act.

grandchild of a veteran – see subsection 116(1) of the Act.

veteran – see paragraph (a) of the definition of “veteran” in subsection 5C(1) of the Act.

Vietnam service – see subsection 116(1) of the Act.

  1. Purpose

The purpose of this instrument is to determine a class of persons for the purposes of the definition of eligible grandchild of a Vietnam veteran in subsection 116(1) of the Act.

Note 1: A person will be an “eligible grandchild of a Vietnam veteran” as defined in subsection 116(1) of the Actif the Repatriation Commission determines, under subsection 116CC(2) of the Act, that the person is included in the class determined by this instrument.

Note 2:  A person who is an “eligible grandchild of a Vietnam veteran” may qualify for a Long Tan Bursary – see paragraph 7.3.2 of the Veterans’ Children Education Scheme (Instrument 2015 No. R43).

  1. Determined classes of persons

For subsection 116CA(1) of the Act, the following class of persons is determined:

A person:

(a) who is a grandchild of a veteran who has rendered Vietnam service; and

(b) who is making the transition to tertiary study and is academically able to complete an undergraduate degree (or similar tertiary course of study); and

(c) whose family circumstances are such that the person may require additional financial assistance.
